    Hi All

    I'll try and keep this brief! My current better half unfortunately took out car financing with Welcome 2 years ago as she had a poor credit rating. She had been told she was able to return the car after half of the agreement (this year was year 2 of 4) without any penalty/additional funds required. When she enquired about this recently they have since told her she would still be liable for the rest of PPI they sold her (approx £1500).

    After delving into this she was told when she signed the paperwork that she wouldn't be eligible for the loan unless she took the PPI as well. She's spoken with WCF and they've said write tos ee if she has a case. Reading through another thread it's mentioned that if the PPI is sold in one lump this is also a mis sell.

    My question (at last!!) should she still continue to pay the debt until we've sent in/settled the case. I'm loathed for her to part with any more money but would it affect her credit rating again if she was to give the car back, cancel the contract for the car and cancel the direct debit thus removing the means for them to collect the addtional PPI. It seems daft to continue paying them for us to perhaps get this refunded at some point.

    As an addtional point they've already tried collecting the car before any figures were discussed. Quality company.

    Hi there and welcome :D If you dont pay the the monthly amount, they may pass this over to a debt collector and this will show on the credit file as a default, and you will be harrassed with phone calls and letters. i would put a letter in to welcome for mis sell of this ppi and see what reply you get.Just write a few lines with account number and the reasons you were mis sold and you would like all ppi paid to date refunded with interest, and if you do not get reply in 8 weeks then you will take it to fos.Good luck with this and keep us posted.x

  • Thanks very much for the quick reply, I kind of knew they would/will pass this over if we did stop the payments. Saying that they've said she can continue paying the current amount (£246) for six months to pay off the PPI. I was thinking of allowing them to take the PPI amount only (roughly £60) over the remaining 2 years. This would then be significantly less outlay whilst we were waiting for the case to be discussed/settled. This is on the assumption they could be trusted to take the correct money from the direct debit........

    Does anyone have an address for contacting a CEO at Capital One please? I sent my original questionnaire complaint form off at the end of May and after getting the usual "bear with us while we investigate" letter I go a response on 17th August saying no. They said that unless I had any other comments to make that would be their final word. Well I DID have other comments to make and sent them by recorded delivery on 22nd August, Royal Mail tracker system shows that my reply was delivered to the same address that they had put on their letter within a couple of days. I phoned them on Friday, 1st October as I had not received any response and was told that it is not logged on their system - yet they definitely got it according to Royal Mail. Is there anyone that I can e-mail please?:(

    I would ask them about this and tell them you are claiming mi sell of this ppi and that under the circumstances it should be possible to just pay the ppi amount as this loan in effect has another 2 years to go, if they say no tell them you will take this to fos as you are not happy that you will still be paying this ppi when you were mis sold.They may not agree to let you do this over the 2 years and if they dont give fos a ring and ask how you stand on this, especially with putting a claim in for mis sell of ppi. Please let me know how you get on.x

    well i cant find my original post so gonna give yout an update via here. so i got a £200 refund from Abbey because of PPi on my credit card personally thought it should have been more but not going to complain. Thinking i wasnt going to here back from any of the other companies especially GE MOney i get home from work today and there is a cheque for £400 quid. hurray. They say they paid of my remaining balance of £70 odd quid which i also paid around the same time so i need to look at getting this back also. After a really rubbish day at work this most certainly brightened my day up. Still having loads of trouble with LLoyds (no surprise there) so filed with the FOS this morning. Lets hope i keep getting more cheques come through the post.

    New here, but have claimed back my PPI from HBOS and they wrote to me on the 31st August stating the refund would be in my bank within 10 days. Called after 10 days to be told would be a cheque and actioned by 26th Sept, stating was not good enough she said she would chase it up. Spoke to the original customer advisor on the 16th who stated 10 days and would forward me £50 as an apology, the cheque arrived for the £50. Chased and he got back to me on the 1st October and has now told me the lady who deals with the cheques is on annual leave til 12th October. Could anyone enlighten me as to what to do next as I am getting sick of waiting.
