I refer to your letter dated 16 June 2010 regarding the mis-selling of Payment Protection Cover on my credit card.
You state in the letter that ‘as a gesture of goodwill’ you have arranged for an immediate refund of £2058.88 into my credit card account.
However, before I decide whether to refer my complaint to the FOS, I am writing to you to request – within 7 days – a detailed statement of the breakdown of the calculations including the resulting balance and interest owing.
Furthermore, even though I cancelled the PPC on 14th May, I was told that I was required to give one month’s notice and, therefore, a payment was made for June. I would also like this payment refunded and taken into account in your calculations.
I enclose a copy of a letter that I wrote to Alliance and Leicester on 7th May, requesting a fully comprehensive list of charges added to my account. I have not heard back from them and, on chasing them up this morning, was informed that my letter will have been passed on to MBNA. Please ensure that this enquiry is dealt with and that I receive the information requested forthwith, as the 40-day period is now at an end.
Lastly, any refund, if accepted by me, should be paid to me by personal cheque and NOT refunded to my credit card account. I would like to decide where my money should go.
I look forward to hearing from you within 7 days.

I understand that statements on their own are not covered by the Data Protection Act, yet I’m not requesting the statements per se, but the charges, which I’m entitled to.
I look forward to your response within 40 days, as is obliged under the Data Protection Act 1998. If not I shall seek remedy from the Information Commissioner.

I sent my letter recorded delivery on Monday asking for all payments made to the PPI to be refunded along with interest. I did complete the FOS questionnaire but didn't send it as I thought I would go for a letter in my own words first of all but kind of thinking I should have included the questionnaire as well!!! I also sent a secure email. How long does it usually take them to reply. Thanks again for advice.0 -
Thanks for all your replys, Just to clarify a few points.... original loan APR was quoted at 9.9% and i managed to get it down to 8.9% after pointing out other lender rates and managed to save nearly £50 month on the quoted price. today i was told that the APR will be 9.9% and thats the best deal they can offer as they are setting up a new loan agreement.
Loan is for £12299 over 65 months with the LPI removed (original loan was £14000 over 84 months + £4158 LPI)
The bank is Lloyds and i sent the paperwork back with the claim letter and never recived it back when they replied explaining that they have miss sold the policy.
I decided not to cancel the policy this morning as i thought something's not right and needed to look into it.
My view is, i should not have to get a new loan, but keep the same minus the LPI as they have accepted fault but the lady today said , quote-"it don't work like that". and i was not quite sure what to say next. but surely i should not have to do anything, i have already wasted 3 hours.
So would it be best to start putting things in writing or even emailing Lloyds top man?

What a wonderful website this is, and after reading Jonny-bonz`s recent post i thought i would send in my current attempt to claim back the PPI i had been paying to the HSBC and hopefully get some positive feedback.
I am currently trying to claim back off the HSBC for 4 PPI policies for 2 mortgages that ran after each other. The 1st mortgage (our 1st home) was started in 1998 and had 2 PPI`s attached to it. I then moved house in 2003 whereby i cancelled the 1st 2 PPI`s and remortgaged with the HSBC again taking out another 2 PPI policies. I have since changed mortgage supplier in 2007 whereby i cancelled the last 2 PPI policies with the HSBC.
Now my arguement as to why i think i was misold the PPI was the fact thae both myself and my wife were in extremely well paid and stable jobs which supplied a minimum of 24 weeks full sick pay, private health care and death benefits of 4 x ours salaries and excellent redundancy packages if it would have come to being made redundant, our point is that we would have had more than suffiecient funds / income to cover our mortgages if need be.
When we took out our 1st mortgage we did verbally state this but was pursuaded to take out the insurance "just in case" and as for the 2nd mortgage we thought we had to take extra cover as it was the "norm" we was not told we could get PPI elsewhere also that our employer benefits could be used as cover!
We also had an HSBC credit card from 2004 to 2007 with PPI attached that we are trying to claim back for the same reason.
estimated premiums paid for the 5 PPI`s is £10,050 without any interest that might be calculated.
HOPEFULLY we may see some return in the near future as i have written the 1st letter enclosing all copies of the PPI and C/C details as well as our employer benefits package and private health cover. I hope this should do the trick but i would be extremley graeful for some feedback from the wonderful people at MSE.

Hi Harry and welcome
In my opinion going by your post, I do think you have reasons to make a reclaim on the ppi.
I used to think that ppi was all part of the loan/credit card etc, because it was never explained or otherwise discussed with me.
Dunstonh on this site is the one to give advice on mortgage ppi, although i assume it all works the same as loan ppi - such as when making a reclaim.
You can of course post a separate thread below if you want to, it does not matter, if you do you can subject this as "mortgage ppi reclaiming", something in those lines, and dunstonh will surely be along to give some advice on this if required.
However, I do hope you get a positive outcome out of this, so wishing you the best of luck and please keep us posted, cheers.;)

I have to say it has been painless and nice and easy(so far).
I still want to cover the loan with PPI for my wife as i have a secure job. Can you recomend any sensibly priced companies?

Right to what I am aware of there are a few that offer stand alone protection, always check that it suits first, these do normally work out cheaper, than the banks own.

It didn't take them that long to reply once I'd written to MBNA, though they gave me a date that they would reply by and went past it, saying that it was taking longer than expected to do their investigations, but they gave another date and I got the information by then.
I did get a refund, remember, which was offered virtually straight away. It came before the breakdown of charges that I had requested. To be fair, the breakdown did match what they had offered to refund, but, as you know, I had asked for a cheque and only got the balance taken off my credit card balance.
This has reduced my monthly payments, of course, but I have now forwarded the letters and breakdown to the FOS because I do believe the payments I made (which included PPI) should have reduced my outstanding balance by even more, had I not had to pay some of the payments towards PPI. That is not putting me in the position I would have been in if I had not had the PPI - it can't be! They've literally just refunded PPI and not taken into account how much my balance would have been reduced by if all of my monthly payments had gone towards paying off the loan itself.
That's why I suggested you bear that in mind when you write to MBNA.0 -

While i am on the subject i have also had numerous credit and store cards dating back to the start of 1998 and being closed at around 2004/5 unfortunatley i do not have all the A/C numbers, in your expert opinion how could i find these out ? i would be grateful for some advice.

Hi Harry and your welcome
You can try checking old account numbers out by old banking statements, or monthly statements.
Maybe the business may still hold some data on the accounts, but most only hold them going back the last 6 years, but any if yours were also settled within the last 6 years, there may still be some info held on them.
With monthly statements, for credit/store cards, the account number should be shown on them, with banking statements the account numbers are normally shown next to the monthly repayments, so if you bank online and have taken out loans etc where the repayments came out of your bank may allow you to go back up to 6/7 years sometimes even more.
I would rule all this out first.
The other way is to request a Subject Access Request (SAR), where they have 40 calendar days to comply and send all they still hold on the accounts, for this you normally require the account number - in order for them to make it easier to track down your data, but just give them as many personal details as possible, full name, data of birth, all addresses held since taken out the finance and so on, this may help.
However, for this you enclose £10 cheque or postal order.
If you taken out so much credit out with the same company, one SAR is required as this will cover all you actually taken out with them, if other companies, then separate SAR's would be required.
If they are unable to supply any data, they will return your payment, and explain in writing.
There is a SAR letter template below, if you decide to do this, I would suggest to also post by recorded delivery, to ensure your letters are received.
