  • HI any advice would be greatly appreciated. After looking at my A&L credit card statements I've discovered that I have PPI which I can't remember being sold. Just want to make sure I'm doing the process correctly. After reading some of these links am I right in assuming I don't need to get a copy of the T&Cs as I've been mis sold and I can go straight to a letter? I was going to completed the questionaire but have decided to do my own letter (after reading some of these posts felt that would be the best option). I've done a letter with the reasons why I think I've been mis sold ie didn't know and also noted in my letter that they (A&L) have recently been fined by the FSA for failing to treat customers fairly. I've also asked for a reply by 8 weeks and that if my outcome isn't satisfactory then I will be going to the FOS. Does this sound ok? Am I doing the right process? Don't want to muck my chances up.

    Thanks in advance

    Hi there

    That is fine.
    Well done.:T

Seems like you have it all covered, and that is okay too, by just having the account number and your reasons is fine, and that is also correct, A&L are one of those companies that were fined for mis selling PPI.

Go for it, please keep us posted, and the best of luck.;)

  • Hi,

I am hoping someone here can give me a little advice.

I took out a morgage (for my first property) almost three years ago. I arranged everything through an independant morgage advisor - the husband of a work colleague and someone I felt I could trust. He sold me a Morgage Protection Plan covering critical illness for the entire term of my morgage, 30 years. He made it sound like I had to take out the policy and that I had to do it there and then. There was certainly no mention of other providers and I remember feeling a little uncomfortable with the way he pushed it on me. I definately didn't realise that I had to keep paying for 30 years! It was explained as insurance, like home insurance, and so I assumed I'd be able to alter my policy when it came up for renewal each year.

Basically, I don't know if this counts as mis-selling, and I'm not sure if I should be complaining to Friends Provident who hold the policy or the man who sold it.

What do you think my chances might be?

    Hi and welcome

Its possible you may have a reclaim case here, but you can wait for other opinons on this first if you want to.
You should not have been pressurised into taking this out and should have had an option to choose your own protection.

So like loan ppi and a reason like yours it seems a likely case.

What you do to make a reclaim is, complete the reclaiming questionnaire, send it to the broker as he was the one who set up your policy, so therefore he is responsible.
Keep a copy for yourself as well, in case you need to refer to it at some point.

They have 8 weeks to give a decision but may request for more time, this is fine for as long as you know where you are.

The reclaiming questionnaire you will find here as stage one:

    Good luck.

    Hi there,
Is there anyone here with any experience dealing with The Funding Corporation personal loan mis-sold PPI. In February 2004, I phoned Funding Corporation for a personal loan and was approved straight away. I was told that the credit agreement was to be couried to my home for me to sign the following day, so the biker (courier) turned up at my home with the documents and stood there while I signed it and then took it back. I had no time to read the document at the time. Recently having read from Martin's newsletter, I asked them for a copy of my agreement which I received yesterday. They charged me PPI - £2,884.40, Loan £6,000 and interest £2,487.60 Total=11,352.00. I settled this loan on 30/6/2004 - I paid £9,252.73. I believe I stand a chance to claim PPI since I was not aware it was included in my loan. The loan was supposed to paid in 62 months. The APR 9.9% - can anyone here advise me on how to deal with them - complain - who to contact/address etc.

have posted on your other thread https://forums.moneysavingexpert.com/discussion/1838197

Hello Lovely Di, hope you are having fun mixing with the celebs in Wales!

Do you know how the FOS are making the Insurance companies responsible for supplying PPI ? (when another company sold it but are not under FOS jurisdiction)
What can the FOS say the Insurance provider did wrong? I have a couple of these with the FOS at the moment.xxxx

    Thanks

  • HI,

i have been reading everyone's responses on here for a good month now. I finally got around to trying to claim PPi not really hoping for much luck. The companies were Abbey Credit card, HSBC Credit Card, Debenhams Store card (GE MONEY) and a Vanquis CC. Well i have had my first response from Abbey with a refund of just over £200 quid and all i did was send one letter, i thought i would get more but at the moment anything is better than nothing and they are transfering my money once they receive my acceptance response. HSBC say they still need more time which is fine, Vanquis didnt offer me a refund but they have now taken off the protection. GE MONEY however i havent heard from at all. think i will be chasing them again soon.

I just wanted to say thanks to everyone for all their tips in trying to succeed with this it has helped greatly. Now to hit the banks with my massive bank charges. Wish me luck and thanks again.

Hi Pinknico honey, hope you and your lovely family are well. X

    Yeah its exciting isn't it?
Although not came across any of them myself yet, my bruv in law the pilot is though.;)

Right, well up to now, mine is actually being dealt with by a Adjudicator with the FOS, so they did end up passing it on and not refusing to look at it, against the insurer of Hamilton.

So I am just waiting to hear now.

I understand they are trying to make them responsible, because when the policy was sold, its passed on to the underwriters/insurers, who give the go ahead, so they must make sure the ppi is acceptable and eligible, and these are the ones to give the go ahead on the loans and ppi.
That is what I have been told anyway.
So they are also part liable.

    Does this make sense?;)

    Hello and welcome

Well done on your first success.
Did they also offer the interest with this too?
This is generally given if they accept liability, and not always given on a goodwill basis though.

Good luck on the others too.
They do normally have 8 weeks to give a decision, but lots of companies have backlogs of these complaints and are asking for more time.

So keep at them, good luck.;)

    Hiya

Do you still have running accounts with them?
For instance if you bank with them you can check statements going back for the last 6-7 years, and if you bank online you can check these straight away.

Or another way to request for the statements, where you will be sent other data held on the account the same time is to request a Subject access request (SAR).
    https://forums.moneysavingexpert.com/discussion/1475553
You enclose £10 cheque or postal order for this request, but if you just request for the statements alone, I am aware you may have to pay out more, this way is probably the best way cos you will receive as stated everything else they still hold on the accounts too.;)

For just the loan credit agreement, its just £1 cheque or postal order, and they have 12-14 days to comply.
The details of the loan and ppi are shown on the agreement.

I have checked with halifax online and they are only there from 2009! Even in my archive. Will try again! Can I ask them instore?>:D
Total debt £17,135 total paid off £525
