    Lloyds TSB PPI reclaiming
    Hello,

This is my first post, Im looking for some advise and I have had a look through some post on here and Im sorry if I am repeating questions

We have two loans with Lloyds one in 2004 and one in 2005. We believe we were mis sold PPI on both of these loans.

Using the templates I found on MSE I went into the branch in the town (not my personal branch that is 4 miles away) and asked about who I should address the letters to and was told to my branch. We did this and heard nothing in over a month.

We called and was pushed arounf between several depts all of whom knew nothing of the letter! Finally after about an hour on the phone we were told that any post addressed directly to a branch but without a personal contact name would not be delivered and who just be sent to a holding depot then destroyed!

So early June I hand delivered both claim forms addressed to the manager of our branch with a covering letter explaning the above! About a week later we had a call to say that it was being looked into and this was based on only 1 loan which the original letter was about (second letter was claiming for both loans as 1st letter was only claiming for the loan we had already paid off) This in itself is very frustrationg at we had been told that the first letter would never had been delivered!

Now my question is what it the best form of action to take now? It has been over 8 weeks since we had the phone call letiing us it would be looked into.

One of the loans has been paid off before we made the claim and one is still running, we had never defaulted on either loan and the total PPI comes to over £6000

I just feel that we are being pushed from pillar to post and we are not been told the truth at all

    Thanks

    Mad at Lloyds!!!!

    Hi and welcome.

There is a direct address here.........
    Lloyds PPI
    Customer Care
    Lloyds TSB Insurance
    Tredegar Park
    Newport
    South Wales
    NP10 8SB

Do you have copies of the complaints?

If so personally I would forward them to the above address, post by recorded/signed for delivery.
I know its a right pain stating all over again, but it seems they are not getting round to dealing with your issues here.

Or what you could do is contact the Financial ombudsman service (FOS) and let them know 8 weeks have passed and your complaints have been ignored, its up to you, but this is your rights.
Even though complaints may take some time to resolve with the FOS, it "may" be worthwhile sending copies of your letters/complaints to the above address first.

Either way its up to you, wishing you luck with this, please keep us posted.

  • Brilliant thank you,

Yes I have kept copies, I may contact Lloyds and see what they say and then try the FOS. Should I advise Lloyds that I plan to contact the FOS or not?

    regards

You know what I would do (personally) ring the number below, and if your complaint was being dealt with they will confirm this, the number is to that address I added in my above post, because all ppi complaints are dealt with by these, so you will soon know if the bank/branch have sent them on.;)

    Then take it from there.

    Tel 0845 3005599
Explain about your issues your having and if they say "yes" they are dealing with them, ask them on a timescale, tell them 8 weeks have already passed.

However, do not take any offers over the phone and make sure all is in writing.

    Hope this helps.;)

FOS can get round the statute of limitations act the same way as you would in a court. Its the same rules as section 32 of the LImitiations act in that FOS would look at it that if you only just became aware of the complaint then this is your date of knowing you had been missold and not the 6 years ago.

    Section 32 says

32 Postponement of limitation period in case of fraud, concealment or mistake

    (1) Subject to [F1subsection (3)][F1subsections (3) and (4A)] below, where in the case of any action for which a period of limitation is prescribed by this Act, either—
(a)the action is based upon the fraud of the defendant; or
(b)any fact relevant to the plaintiff’s right of action has been deliberately concealed from him by the defendant; or
    (c)the action is for relief from the consequences of a mistake;
the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.

Marshallka - many thanks for this very useful information. (Apologies for my delayed response as I don't log on very often)

I have been pondering my next move for a few days now - but will certainly not be giving up as there is a lot at stake. I'll let you know the result as soonas I have one.

    regards

    Cool- Thanks for that!
Now I know roughly what to expect!:)

Anyone any ideas of how long Lloyds take to pay up once the acceptance letter is signed?

    Hi again,

Just wondered if anyone had an answer for this?
I sent my acceptance letter to Lloyds on Thursday last week... how long will it take until the refund hits my bank?
Would it be a week or so or are we looking at a month or two?

So far they've taken less than a week to respond to my complaint and indicate they were offering me a refund. Hopibg the speedy process carries on!:)

the standard procedure for Lloyds once you have accepted is to issue you with a full breakdown of the refund within 21 working days (and it takes this long) then within this letter they say the payment can take up to another 21 days to reach your bank,

    i hope this helps
I'm proud to say that the banks no longer take money from me after becoming debt free

    Hi Manc,

Some are told 21 working days and others 45 as from receiving your acceptance, but I would email them to make sure.....

Remember to enclose your claim complaint ref number, hope you don't wait too long, good luck.;)

    Hi to all,
My letter from the FOS was sent to Lloyds on the 28th July and they have given Lloyds 4 weeks from that date to contact me directly in order to finalise the matter.
The 4 weeks is up this Wednesday, 25th August, and not a word from them yet.
I have sent them 2 letters and sent them 5 emails, including copying Eric Daniels in. I have spoken to the credit card customer care and they can only tell me that the notes on the system confirm my signed receipt on the 29th July and that it is with the customer concerns team. The email I sent last week has also threatened them will FSA intervention.
    Couple of questions........
    1. What are the FOS likely to do if I dont hear from Lloyds by Wednesday.
    2. Am I able to take any legal action against Lloyds as they are not adhering to a legally binding decision by the FOS.
We are one month away from it being 3 years since I first complained to Lloyds, they ignored the adjudicator decision in my favour and are now failing to correspond with me.
I am getting extrememly p***ed off
