    Yeah, I realised that one but I did not know if there was actually details on it or just a template letter?? I did ask if there were details of the customer on it??:question::)

    If it is breach of data then the poster can perhaps get an apology and I doubt much else but the person who has had their data leaked could perhaps kick up a fuss. Don't really know how it works and yes, it is disgusting but the government seem to do it and get away with it too lol.

    Some advise and assistance is required if you can help me please! ;)

    I am helping my parents trying to reclaim PPI on a account they have had from a loan taken out in 2007.

    We sent the first template letter to Nemo finance who then sent it onto AWD group.

    We have had a letter back from them and im not sure of the next course of action to take.

    The reply letter they sent said they have completed their investigation based on the complaint of being mis-sold on the following points

    - we were led to belive that our account would be rejected if we didnt take out the policy

    - the policy exclusions were not explained to us prior to/during the application for the policy. we were therfore unable to verify wherether the insurance was appropriate for us.

    - my mom has MS at the time of the sale and we were unaware of the policy exclusions for pre-existing medical cond.

    - we were not advised that the policy premiem would not be paid for up front as a single premium and added to the debt with intrest.

    - the insurance will expire before the loan agreement which means we will be paying intrest on a policy that no longer exists.

    - we require a full refund of the premiems paid plus intrest at 8% and compensation for being deprived of these funds.

    They then go onto say the PPI policy was taken out on a 'non-advised' basis. AWD loans did not provide advise wit regard to the purchase of PPI cover and merely provided generic policy info.

    It then goes onto say about what docs were provided to us as well as pointing out various sections of T&C's. Cancellation, Early Settlement, refund, Premium.

    And goes on and on..

    However the conclusions states.

    Based on the information in respect of the comparison document. demands and needs document , the payment protection guide, loan options forms and protection plan application form it was YOUR decision to proceed with the loan.

    However as a result of our enquiries it is evident that the policy term expired prior to the completion of the loan term. On this basis we propose to uphold the complaint and complete a loss assesment in accordance with the guidance available to us by in industry regulator and the financial ombudsman services on the basis that this policy was unsuitable.

    In order that we can complete this loss assesment we will require that you complete and return the letter of authority - on receipt of this we can approch Nemo loans and Aviva for current details and the status of your loan and PPI.

    It also goes onto say that

    :mad: in order to accept this offer we will require that you both sign and return the acceptance form in full and final settlement within 4 weeks of this letter :mad:


    What should we do??

    I would appreciate some help and support from those of you who are in the know!!

    Hello again, I am struggling with what to put in section E of the form. In answer to "and finally, please tell us why you are now unhappy with the insurance" do I just put "because it would not of covered me due to me being a company director"

    I assumed after 2005 that all loans were sold on an advised basis, hopefully someone will clarify on this one for you, or google search it.

    If this was meant to be an advised sales, this should have been explained to your parents, the broker have checked anyway to make sure they would be eligible to make a successful claim due to this reason, they obviously did not sell this in your parents best interest.

    - we were not advised that the policy premiem would not be paid for up front as a single premium and added to the debt with intrest.
    Lots have complained due to this reason alone, and they have now stopped selling these within the loan, especially these types of policies, they are costly and a rip off, you have good reason here to make a reclaim just on this never mind the other reasons.
    There are dim views on these policies.

    - the insurance will expire before the loan agreement which means we will be paying intrest on a policy that no longer exists.
    This again is another reason really why this should have been upheld because your correct in saying that they will still be paying out on this policy for the life of the loan, so annoying indeed and this of course was not explained to them either it seems.

    - we require a full refund of the premiems paid plus intrest at 8% and compensation for being deprived of these funds.

    So they have upheld it in your parents favour then which is a good result.

    So just as long as your parents are happy with the result then they can sign to accept.

    I would make sure though that they are calculating inline with the Financial ombudsman service (FOS) first, so this should also include interest as well.

    Hi there

    Explain you don't believe it was sold in your best interest.
    And I would not have benefitted from the policy, so its worthless to me and deprived me of my money.

    So depending on what reasons you have really as well.;)

  • Lloyds TSB PPI reclaiming
    Hello,

    This is my first post, Im looking for some advise and I have had a look through some post on here and Im sorry if I am repeating questions

    We have two loans with Lloyds one in 2004 and one in 2005. We believe we were mis sold PPI on both of these loans.

    Using the templates I found on MSE I went into the branch in the town (not my personal branch that is 4 miles away) and asked about who I should address the letters to and was told to my branch. We did this and heard nothing in over a month.

    We called and was pushed arounf between several depts all of whom knew nothing of the letter! Finally after about an hour on the phone we were told that any post addressed directly to a branch but without a personal contact name would not be delivered and who just be sent to a holding depot then destroyed!

    So early June I hand delivered both claim forms addressed to the manager of our branch with a covering letter explaning the above! About a week later we had a call to say that it was being looked into and this was based on only 1 loan which the original letter was about (second letter was claiming for both loans as 1st letter was only claiming for the loan we had already paid off) This in itself is very frustrationg at we had been told that the first letter would never had been delivered!

    Now my question is what it the best form of action to take now? It has been over 8 weeks since we had the phone call letiing us it would be looked into.

    One of the loans has been paid off before we made the claim and one is still running, we had never defaulted on either loan and the total PPI comes to over £6000

    I just feel that we are being pushed from pillar to post and we are not been told the truth at all
