PPI Reclaiming Discussion part 4

Hi there
There is a member her called Incipience, who have left many interesting posts in regards of reclaiming PPI from both lenders and brokers etc.
They apparently both have a part and responsibility in this sale.
I would write to the broker then and enclose a copy of the lenders letter, so they know you have already tried to reclaim to the lender and will prove what they have said, also if you still have the copy of your complaint/reclaim letter, enclose that as well, tell them you would like this investigated by them and expect to hear by 8 weeks - unfortunately yes its 8 weeks all over again.
Any problems, I would contact the financial ombudsman service here:
http://www.financial-ombudsman.org.uk/consumer/complaints.htm
They may do this for you on your behalf, like they did with one of mine, then of course the response comes back to you from the broker.
See what they have to say.
You will find the SAR in the SAR thread with details, good luck.;)
Di, I've already had some advice from incipience about my other claim from first plus so I know all about the brokers agreements etc - however this case is not that straight forward, we went through ocean finance and got a loan from first national - have all the paperwork with first national on it - now when we contact first national they say ANOTHER company was involved called Alabaster - I have done searches on these lot and got nothing back from Jersey where 1st nat say they are based. I have sent off SARs for previous claims so will just send one off to first nat for more detailed info - thanks anyway0 -
Hello Toffee Penny .You are more likely to get the agreement in a SAR request as the loan is settled, but it is worth a try going the £1 route. You could also send a follow up letter about your complaint to see whats happening.DS1 12/10/04

We had a loan with Marbles which started in 2004 and was paid off early 2005/06.
I wrote to them using template letter from here for mis-sold ppi and they replied on 29th Dec 08 saying they would contact us shortly. We haven't heard anything since their first letter.
We do not have original loan paperwork, I found the info from OH old bank statement from 2004 ( I'm like a hamster I hoard stuff)
Should I just send the £1 request for the CCA for this account or do we have to do the £10 SAR to get the information on the ppi?
Ey up,
If its the cca your after just use the £1 fee to TRY!!!!!! and obtain the agreement:j Let him who be deceived ,be deceived:j0 -
Hi Sharibe
Lol, your not being impatient hun, its only natural that you want to know.:D
Right as the volumes of these complaints are at its highest right now it may take some time, but what I should have mentioned earlier is, if your struggling financially right now let them know on a letter to enclose with your complaints form, they may consider fast tracking for you.
Mine was fast tracked due to my current financial cirumstances.
They received my form in June/July 2008, in September it was moved on to the first caseworker/adjudicator, it was agreed by the caseworker that is should be upheld, but lloyds would not have it, so then they moved this on to fast tracking in DEC/Jan to another adjudicator that is working closely with the ombudsman, again the FOS agree to uphold, and awaiting feedback by the 20th of this month, so fingers crossed, I will let you know.;)
But like I said let them know if your in hardship right now.;)
Editing to come back in.
Mine was not just financial hardship but other personal reasons as well which cannot be disclosed on this forum and have not been disclosed, but the FOS will look to see if that is enough for fast tracking, if they think it should be due to your personal circumstances they will do so X
Oh Di, that sounds very frustrating for you hon. I have to say that I am now very fortunate in that I don't desperatly 'need' the money (I bloody did back when I had the loans!!), I just want what is mine back hon. The more I think about what they charged people the more angry it makes me. I have just noticed on one of my loans (the one they had a personal summary/reccomendation,) they put that it would NOT cover me for redundancy as I had told them I was at threat of redundancy!! I was then made redundant a few months later and had to use £18,500 of my redundancy pay (half what I got)...Oooh it does make me cross, When I see what people on here are going through.
Have just about got all my paperwork sorted to photo copy tomorrow at work! And will finish off my form tonight once the little one has gone to bed and I have some peace and quiet!! Lol
Thanks hon.0 -

Just thought I would let you know Nat that I have been fighting my ppi case since 2004 and it still goes on to this day. Believe me I been very stressed.
I am thankful that most people can go to FOS for help because I can't and would not want anyone to be in the fight I have had to go through all these years.
It does not matter that people are able to use fast-track with FOS, good on them if they can, if I could I would certainly use it and I am sure if you could use it you would to.
What difference does it make, I'm having financial difficulties, worry about this worry about that, but can't get help from FOS, but so what thats just the way it is and I'm certainly not going to stress about the people who can use FOS or fast-track.
Everyone still gets served at the end of the day.0 -
How do you know people are not being treated fairly?
Yes, different degrees of stress but how do you know that your stress is worse than the next person?
The whole question is why are people being fast-tracked, the answer is they are able to use the service and so they should if they can.
I think we should save our energy for fighting to win back PPI and not worry about others using the fast-track system, its a pointless debate.0 -

Time to change the reclaim figure on my signature!
Hi there
This is good news:beer:
I have just sent the 1st template to EGG and receive a very quick acknowledgment, heres hoping I win this one too.
Received my SAR however they say they don't have any telephone calls so left the ball in there court now to prove ppi was not mis-sold.:wave:0 -
It is not sour grapes, I am just sick of reading posts where posters are pushing for fast tracking or have got fast tracked for trivial reasons.
Everyone in this day & age needs the money & if they were all treated equally & fairly there would be no arguments.0 -

There are others on here who have been fast tracked, marshallka, di and others but so what.
In order to get somewhere with your claims you need to keep on at FOS just to keep reminding them you are still here.
You also need to think that not all posters using fast track want to explain their whole reasons for being able to use this service, some may find it embarrassing to explain fully their situation, so what may appear to be trivial to you may not be the full reasons.:wave:0
