Hi again,now i have calmed down a bit and re read my lettter from Alliance and leicster i noticed i have only been paid out on one account.When i wrote my letter i put down two accounts that i had been missold ppi on.The one they have paid out on is the most recent one which ended in 2004.My question do you thiink i will hear about the other account or should i have written about them seperately and should i phone up tomorrow and enquire about it or do you think because that one ended in 2000 im not getting it.Sorry about this but another question when u are getting paid back on a ccc do the take the interest from the time the card was taken out or just on the last 6 years.TIA everyone xx0

Got a response from Lloyds TSB today. Im a bit confused because I dont recall posting a claim for both the loans as I thought I'd wait for the SAR as DH couldnt recall the details of the first loan,and I dont have a proof of postage for that one either.
Anyway, they rejected that one.It was the first loan and the PPI amount was £1055.34. The rejection letter gives the whole "our sales staff are trained to go through all the screens and follow the onscreen prompts etc"-do I send them another letter (or the questionnaire again) asking them to reconsider? Or do I go straight to the FOS? If so, what do I say (cover letter)?
They have upheld the complaint for the second loan which had PPI of £3265.79 :T But I'm curious about the letter and wondering if I understand it right, and if it's the best deal we'll get?
The offer:I have decided to uphold your complaint and offer to settle in the following manner which is in line with the standard redress remedy recommended by the FOS. I propose to:
A)Calculate a refund of the PPI monthly payments that you have paid to date and
B)calculate simple interest at 8% per annum on each of the monthly payments.
If you would like a clearer indication of the PPI monthly payments you have paid to date, please see your original cca you received when taking out the loan....
The 8% simple interest amount will then be calculated when I receive your acceptance. This will only be processed at this point to ensure the figure is calculated accurately.
Should you choose to accept this offer, I will instruct the loan service centre to pay this into the bank account which pays the loan and to amend your existing loan to reduce the monthly repayment . The new monthly repayment will reflect what what your loan repayment would have been had you not purchased the PPI
The letter goes on to remind me that this would be what the FOS would recommend.
Our CCA shows that the current monthly repayment for the cash loan is £254.01 and the PPI loan is £75.41, giving a total monthly repayment of £329.42. Can I assume that once this is resolved, our monthly repayment will then only be £254.01?
the loan was taken out on 16/04/2008, so I calculate 28 months that we've paid into it-giving a total PPI repayment of £2111.48? So what are they offering regarding the 8% simple annual interest? This is what I cant get my head around.
The other thing is we have a rather large ongoing overdraft-on the account that pays this loan...so would they repay into this account? We have no defaults or late payments on any LLoyds products? According to snowball, we want to pay Argos and his Barclay card credit card first-so thats where this money would go? Is that going to be possible?

hi, a couple of bits of information.
the way they are calculating htis is correct, and oyu are correct in assuming that your monthly loan repayments will go down to £254
in terms of oyur refund, you are correct in your assumption that you will get back 28 monthly payments of £75.41, they will then add 8% simple interest on this from the date of each payment ot the date of settlement,
in your case the 8% will be approximately an additional £204
well done on your award and getting your money back.

Now with the other one, I would make a point due to them rejecting this, that you are baffled that they upheld on one and not the other, yet for the same reasons.
Tell them you don't believe this rejected complaint was investigated properly, and the FSA are punishing banks for rejecting genuine complaints.
I would actually email them on this and copy it to the Chief Executive officer (CEO), Robbedofmymoney will tell you, this normally works.;)

Ask that they confirm they have received your email and that they will be looking into it, also ask that they let you know by 7 days, because otherwise you will be complaining to the FOS, with your evidence you have, and you will also be requesting for further redress for the inconvenience and distress this have caused.
