Thanks Di,so you also agree-take the offer? Can I ask if you have an answer about the overdraft?

I was thinking about the rejection of the first claim-I cant find a proof of posting for that one and I just found an envelope addressed to "Lloyds PPI" on my desk-so I havent sent them a claim as far as I can remember. The only thing I can think of is that they did this in anticipation. In my claim for the second loan, I did reference the first loan-in part as explanation.

In the SAR there was a statement stating the first loan was settled early (obviously because it was included in the second) but there is no mention of a PPI rebate for early settlement?)

Do I wait until after Ive accepted the offer on the first loan before I email regarding the second? And is it alright if I do a draft and post it back here for you to proof read?

I just phoned DH to tell him...when I told him the figures he was very quiet-and then I could hear him gulping before saying "sorry, come again?" He is so thrilled. He wasn't keen on me claiming to start as he didnt want me getting stressed whilst waiting for the baby-but now, with 44 days to baby's arrival-I feel like I can conquer the world:D

    Hi :D

If they have upheld in your favour, then this is the best decision, because they aim to put you back in the position as if ppi was not taken out.:), if its an offer then they could offer just anything.

I am not sure in regards of the overdraft though, but you can request that they refund the money directly to you, because you have already been deprived and out of pocket due to being mis sold the policy in the first place, and of course if they continued to do this, and your not happy, you can then complain about this to the FOS.

Maybe you could email them about this one, ask them to send you a copy of the information you sent them on this reclaim, tell them you want them for your records and you cannot find the details (mislaid), I am a little baffled on this one to be honest.

Yes maybe it would be a good idea to sort this one out first, so that they don't get confused, I do know that Lloyds have extortionate amounts of these complaints and are dealing with many thousand refunds of PPI.
Yes do feel free to post up the draft.;)

Thanks Di I am looking after myself-and even better I just worked out that if I get the £2300 Im expecting, we have enough to pay off the Argos card, the Studio account and both credit cards :jleaving us with only the loan and the overdraft to pay. And reducing our monthly requirement for repayment of unsecured debt from £406 a month, to £275  and bringing our DFD from 36 months to 25.

    Hi and welcome

You complete the FOS questionnaire and send to whom is responsible for mis selling the ppi, they have 8 weeks in full to respond.
The questionnaires are used instead of letters.
Remember to keep a copy as well.
The fos questionnaire you will find further down the page as Stage one.

  • Hello all.

I have a quick story and would like to know if they can really do what they've done.

I have a loan with BH, its running for 10 years for which I was told I needed PPI, so I did - assuming what he said was fact. I've never taken PPI before as I work in an industry where I would never find myself unemployed for too long (bold statement :-))

I took out the loan approx 4 years ago and I recently called to cancel the PPI after all the bad press it was getting, hoping for a reduction in my monthly payments. This is what I was told, in a round about way.

What they said was that the total cost of the PPI is collected from the monthly payments first - then the loan repayment follows. If I cancelled, my payments wouldn't decrease much and I'd lose the protection.

Now, I'm not saying that's exactly what I was told, but they were words to that effect. I'm hoping I was fobbed off and if they did try to fob me off, that's even more shocking ! I've not had a good read of the agreement so can't comment on whether the above is in the small print somewhere. I thought an insurance policy was paid alongside a loan and it could be stopped at anytime and subsequently lose the cover.

I am in the process of filling in the first questionnaire as I intend to get my money back.

Any similiar experiance to that above or is this a new tactic.

    Thanks C.

Hi everyone, I'm new here and at the beginning of the process and am wondering already whether this claim is going to be worth pursuing as I'm already a bit confused...

In 1998, young and stupid, I took out a storecard with GE Capital (now Santander). I was an agency temp at the time and as I signed up for it with a shop assistant, alongside a purchase, I did not get any advice re; the PPI.

Between jobs and with money worries in 2001 I asked if it could be cancelled but was told that it was compulsory and I didn't disbelieve them. On that occasion I wrote saying I couldn't pay and so had the interest removed for several months, which helped, but not the PPI. I still have the storecard but cancelled the PPI when a booklet was sent to me saying it was possible to do so in, I think, 2005.

Two weeks ago I realised I might have a case but had no paperwork so I wrote to Santander requesting it. Today I received a very incomplete set of copy statements dating back to 2005 only (explained as a data transfer failure) and a letter which stated that the missing months would be considered in any refund offer that might be made. The letter then stated that the total amount of PPI paid is 211.47gbp. I do not know how this figure was arrived at or what dates it covers, as the statements sent do not show anywhere near this amount (which seems to be about 2 years worth of payments) and the amount actually paid over the term of the policy (8 years) must have been much higher as I carried a balance of several hundred pounds throughout this time at a rate of 1.50 per 100 owed.

I am now thinking I should ask for a copy of the original agreement and wondering if it is true that a record of the total amount paid into the policy was not kept on it's cancellation 5 years ago.

I'm seriously thinking of giving up at the first hurdle here as I know this is an old one and the claim will be for a relatively small sum. any advice on which way to jump?

    thanks for reading, Munichjoolz
