Hi Di
Hope your ok. I sent a letter to barclaycard and asked for my orignal terms and conditions and now I have them. I then sent the template letter asking for a breakdown of my insurances charges and today I received a letter asking for a £10 cheque so they can release this information. Is this correct please? once again thankyou in advance for your great advice.
JJx
Hi, hope your well too, not too bad thank you.
Basically then they want you to request a Subject Access Request also known in short for a SAR, this is where they send all they hold on the account(s) by 40 calendar day with a payment of £10 payable by cheque or postal order.
So in this case I would do this in forms of a SAR letter request.
Template letter of SAR here:

Hope this helps, good luck with this.;)The one and only "Dizzy Di"0 -
I didn't know I was cheated by HSBC until read this PPI post and thread.
Nov 2004, I graduated from MSc course and got an employment contract from a London based company. I had to loan £4500 from hsbc to pay for relocation, rent, and credit card etc. HSBC had promotion rate of 7.9% for graduates. On the day I signed the graduate loan agreement, they told me the premium "is good for you" and can be cancelled in xx days. When I tried cancelling it on the second day, they tried many ways to persuade me not cancel it and eventually they told me I must have it because I wasn't uk citizen, didn't have a house, didn't have family in the UK etc. Even I told then my employer gave me Life Insurance. So I had to pay 648 for insurance. I repaid all in 2 years after that. That employer gave me nearly 7,000 pounds tax free package when made me redundant in 2008. Obviously I didn't need that insurance.
I am really angry now. Those bankers should get punishment for cheating - but seems I could only get money back.
I am filling the questionaire now. I kept all documents, including credit agreement, loan terms and insurance sales acknowledgement slip - it covers unemployment disability and life assurance. Surprisely they are just 3 pages A4 paper.
The breakdown:
Amount of loan 4540, Charge for credit@7.9% 369.47, total 4909.47
Premium 607.79, amount of loan@7.9% 48.82, total 648.82
Question 1: do I need to attach all bank statements for repayment history to this questionaire?
Question 2: Shall I expect to get £ 648.82 back from HSBC?
Question 3: section A4 "what is policy number of insurance" - I can't find this number. The agreement only has Loan account number, shall I write this one?
Question 4: section D employment - I got the employment contract in October then loan in November and then my job started in December. I had a part time job at that time. Should I choose "fewer than 16 hours a week" or "employed"?
Thanks for your help.0 -

Further to my last post - I wrote back to MBNA after receiving a 'goodwill gesture' of a refund of PPI, asking for a full breakdown of how they'd arrived at the amount being offered and enclosing a copy of a letter that I'd originally written to A&L, asking for a list of all insurances on my account (as per your template letter). A&L had not replied within the 40 days and, when I chased them up via a phone call, was told that my letter would have been passed on to MBNA to deal with.
Anyway, MBNA had said that they would not enter into any further correspondence when they wrote with the goodwill gesture, but, following advice on this site (thank you!), I wrote back to ask for a breakdown of how they'd arrived at the figure being offered, as I should get this. I have now received a letter from them thanking me for my recent letter (!) and to advise that they are 'investigating' my complaint and will issue a response within 28 days.
Does this sound promising? Could I have missed my chance to get some money back by not accepting the goodwill gesture straight away?0 -

Hi there
First of all good luck with your reclaiming, and yes I bet you feel very bitter indeed, now go and get your money back.;)
Ans 1 - Its optional to attach any evidence, but if you do, only attach/enclose copies and not the originals.
Ans 2 - You Should expect all you have paid in PPI to the account, interest and also request the 8% interest of what a court would award.
Ans 3 - The loan number is usually that of the insurance number, and because the insurance is paid within the loan, so write the loan account number.
Ans 4 - You write down the actual position at the time of when you taken out the loan in Novembe, so if this was less than 16 hours a week also write that in as well.
Hope this helps, fingers crossed for you.;)The one and only "Dizzy Di"0 -
Hi Di and Amersall,
Just a quick update for you.
The FOS have emailed me this morning to confirm that my complaint has been prioritised due to age of claim and the difficult circumstances I am facing, although it may still take some time to be allocated to an actual Ombudsman.
I also e mailed the Money Saving Expert team yesterday to let them know about my plight and the fact that my 2 and a half year wait with the Ombudsman seems to be very, very strange and against the trends that appear to be noted on here, even by Martin himself.
I will keep you updated, as ever and thanks again for your support.0 -
