I understand that you don't remember agreeing to the payment protection insurance (PPI) policy. Having reviewed your application, I can see that you didn't ask for PPI at that time. However, our records show that we offered you the policy during a phone call on 20 June 2003. Whenever we offer PPI, we always ask our customers if they'd like to take advantage of this cover and explain the criteria for having it. And before adding it to their account, we ask them to confirm that they want this. Also on your statement, we tell you how much PPI we're adding that month. The amount of insurance that you pay will depend upon your balance during that month. If you have any other queries, please send us a further secure message.

    Right well they have confirmed they have records there on the telephone call, so I would write to them and ask them for the copy of the calls.

    And in my opinion they should therefore still have details on your account.

    Write to the data dept and enclose a £1 postal order or cheque payment and request they send you a copy of your agreement by 12 days.

    I would as well try to keep everything in writing and copies in case you decide to want to take them to the financial ombudsman service (FOS).

    If you want all your info, hopefully they still have all your details, the other way is to request a Subject Access Request (SAR) which actually costs £10 by cheque or postal order payment.

    They have 40 days on this one to comply and send all they still hold on you.

    I would also suggest to post all letters by recorded delivery, for your proof of posting.

  • Hi thanks for the quick response.

    I may aswell go for the whole hog and request the SAR, one question though...will this include the transcripts of all of my telephone conversations or will I have to ask for these seperatley?

    The recorded delivery is a good idea, thanks for that one too ;)

    Yes it should do, with dates, times what the conversation entails and so on.;)
    Some have been lucky in requesting these free of charge as well, separately to the SAR.

    hi sorry to bother you all again. Just on my way to post the letter and i have just received a letter from insurers and need some advice please.

    This department is in a receipt of a complaint that you have made concerning the sale of a ppi policy to the fos.
    My enquiries into this matter are continuing. There are a number of issues under consideration but i hope to have some further news shortly.
    I am obliged to inform you, at this stage, that you have the right to refer your complaint back to the fos. I enclose a leaflet for your information. I hope however, that you will wait the outcome of my investigation before taking any further action. I n the meantime if you have any questions please contact me.

    FOS will not investigate a complaint unless the insurer has had eight weeks to sort it out or, if earlier, given you a final response.

    thanksfor yor reply their eight weeks is up thats why im asking what i should do. if ou read the letter again they are asking for more time and i dont know wether to go to the fos or wait?

    This is now discreetly up to you if you want to sit on this one a little longer to see what happens.
    But of course as you know you are eligible to go to the FOS as the 8 weeks have passed.

  • Hi - quick question. If Barclays do not respond to my request for PPI refund within 8 weeks, can I go straight to the FOS?
