    Hi

    I am about to send a letter to HSBC, requesting details of previous loans I have taken with them including PPI. I wonder if anyone can tell me what address I should use please?

    Also, am I right in saying it is best to get this infor first before I send a letter making my claim?

    I've been directed here by a friend who has used the site previously as I have no idea if the below is PPI or not.

    My mother recieved a letter informing her that the insurance policy she was told she had to take back in 1996 when she applied for and obtained a RBS credit card has been cancelled she has reached 65.

    I have read the policy and I am confused by it, 2 parts in particular which I have replicated below:

    Under the definitions section:

    "TERMINATION DATE": the earliest of the following dates:-
    1. the date of Your death; or
    2. the date You reach 65; or
    3. the date on which all sums due to the Coverholder under the Agreement have been paid; or
    4. the repayment date; or
    5. the date on which a premium has remained unpaid by You for a period of 4 months after it is due; or
    6. 5 years from the Commencement Date; or
    7. 4 months after the date of a default by You in satisying any obligation under the Agreement unless You make good the default before the expiration of this 4 month period; or
    8. the 15th day after the Coverholder repossesses any of the goods comprised in the agreement.

    My confusion is here is that surely if the policy commenced in 1996 then it should have ended in 2001?

    The other section is under the General Provisions section.

    9. It is a pre-condition of Our liability that You comply with all parts of this policy and that You take all reasonable steps to minimise Our risk and ongoing liability under this policy.

    So if a claim is made then they can argue that all reasonable steps weren't taken?

    The policy was issued by St Andrews Life Assurance plc and St Andrews Insurance plc.

    My father still has one of these CC with another of these policy which is basically the same but with a date of 70 years of age for the termination date.

    Apologies for the long post and I did try and search the forum but there is just so much :)

    Any thoughts or comments would be most welcome.

    Hi Stephen and welcome.

    Right going by this then your mother would not be eligible to make a claim as she have reached 65.

    Are you saying that your mum reached that age in 2001?

    Sorry if I have not read this correctly.

    However, if your mum was mis sold for any reasons then she could have a go to reclaim all she have paid in this insurance.

    Even though the insurance was covered by St Andrews, you write to the ones who set this up.
    The insurer may come into it later if other avenues have been exhausted first, such as with the ones who set this up etc.

    And the same goes for your dad as well.

    Hopefully others will post up with some advice on this one to for you, but if you feel your mum and dad have been mis sold, then give it a go on the reclaiming.

    Many thanks for the quick reply, my mum was 65 in March this year.

    Just to check, I contact RBS and discuss with them why she was told to take this insurance out with the credit card in 1996 and deal with them regarding it?

    Address .... Just use Martins template letter, you don't need to get the details first you can just go straight in for the claim. They are still investigating mine. Good Luck !

    And your very welcome.

    Basically if you already have details such as the account number then it will not hurt to try to reclaim without the SAR info.

    However, if you just require the loan agreement, so that you do have something to go by, then you can write a simple letter and enclose a 31 postal order or cheque payment, and request for a copy of your agreement, and tell them you expect to receive this by 12 days.
    And post by recorded delivery.

    Now on to the reclaiming part, if HSBC set up the loan then you write to them by giving your reasons, and request they refund you all PPI paid plus interest etc.
    Do not worry about writing down the amounts, if successful they should supply you with a detailed breakdown, or you request for this.

    However, in my experience its best to write in your own words with of course the reasons that apply to you and use the templates as a guide, so you don't miss the main essential of reclaiming.

    hi all its me again i was wondeing if anyone could help? i have received an offer from the insurers of 500.00 and i was wondering if anyone could work out what i am actually owed. here are the details
    loan1 taken in oct2001 at 11.9% for 126 months- 11,000 - ppi 2693 - total loan 13693,00 - monthly payment £186.29 including ppi payment - 23.89 paid 8 payments then had a new loan and received a rebate of 2289.81 paying back 10983.92

    loan2 taken may 02 at 13.9% for 126 months - 18,000 - ppi 4400 - toatal loan 22400,00 - monthly payment £328.39 including ppi payment - 64.61 paid 6 payments and then paid it off and received a rebate of 610.23 paying back 21940.43
    please can someone tell me that if i wanted to go all the way with what figure would i be looking at? or should i accept the offer?
