    Blakespop, I will still be on here every now and then so will still chat. I've got my fingers and toes crossed for you for the 14th July.

    I have to say it was one of the most stressful things I have every done and my poor hubby. I though he was going to have a fit at one point where he was getting sooooo stressed. Just waiting for our back dated pay so we can treat ourselves :D
    so what was it like when you went in? was it friendly or was it all like you are guilty until you prove you are innocent sort of thing?

    when i had mine just two people there, a man and a lady, they where friendly and put me at ease, as im deaf it's , stress makes it even harder for me to hear the very small bit i can, and lip read. two people from disability center came with me to hear and speak for me.i still had to have medical there, but WON

    you had a medical at the hearing? thats too funny, hope not too invasive as will have welfare rights worker there, not stripping off for anyone in full view of others who are not doctors. this week i have fallen down the stairs when legs gave way, have bruises all over from other falls and stumbles, these all make pain worse so now try to walk as little as possible.

    I have read the whole thread and that scan would do you more harm than good so discount it and only use whats in your favor, ATM you might get a short award if it goes in your favor maybe 2 years till you have had the op and any projected evidence will be all but discounted since no-one can predict it.

    The longer the inpingment the more likely perminant damage but this wont show up till after surgery, if when they open you up you have scarred and thickend nerves that will be taken as a perminant disability.

    Many of us will always be in pain dispite surgery but for DLA they want facts only not may or looks like and lumber surgery to remove discs is common and recoverable from so it isnt considered lifelong pre-surgery today.
  • When we went in there was three people, a lawyer, a doctor and a lady who is an expert in living with disabilities. It was quite scary cause you sit infront of them but they do try to put you at ease (didnt work tho lol).

    Doc asked all the medical questions such as when did you have you last fits, what happens when you have them, do you have any warnings they are coming etc.

    The lawyer took notes the whole way through and just asked some general questions and the disabilities lady asked about how we lived i.e can hubby shower alone (doesn't need help showering but leaves door open and i listen out just in case)etc.

    Its was VERY nerve racking and i wouldnt wish it on my worse enemy (except some of the people that work for DLA :D:rotfl:)

    Sorry but I dont agree with all the support for not including the scan results. If the decision maker had some evidence that supported an award of benefit but chose not to send it to the tribunal, would you consider this to be acceptable?
    Surely omitting your scan results simply because they might not get you the award you think you qualify for is the same a misrepresenting your needs.
    What will you do if DLA or indeed the tribunal themselves go to your specialist for more evidence?
    DLA is awarded for the needs arising from your conditions. I would say that the only honest approach is to present the tribunal will ALL the evidence and let them come to the correct decision. Anything else is is just one step from fraud in my opinion.

    The first appeal was put off as when we got there the pannel had only half the paperwork in their pack, someone had not done the copies on the reverse. back wednesday coming and lucky for me have a letter to hand in that my gp surgery sent me regarding my referal for a wheelchair.was being examined at the hospital one day when the "electric shock like pain" went down my right leg and the doctor just stood there looking at how the muscles were cramping up aroound the area yet rest was nice and relaxed, that was the first time he had seen that happen to me and finally he understood how and why I keep falling with the result of making the back start to be more painfull for weeks, lucky for me i was not walking or standing at the time so was ok after it. It was then he agreed that I would always be in danger of falling until they can find a way to stop that happening. have had injections in spine, and SI joints. and pain clinic have doubled my gabapentin with a view to keep boosting it until they get to the max or it stops the nerve pain that shoots down my leg. also am getting acupuncture and a tens machine. did ask if i could have a week in the sun some place but he laughed and said he would keep that for himself. but it has taken 18 months ut am finally being sorted as far as treatment goes. although they have said they can never solve the pain problem and I will just have to adapt to it.

    so appeal pannel will have more to get their teeth into as pain and condition have not changed since i first applied, just the doctors i am now seeing are better than my GP who did not seem to care.

    Will let you all know how I get on on the 26th as should be on more than just low rate care as am now.

    Well had appeal but know nothing yet. they took 90 minutes interrogating me and then said they would post the decision out to me. so now its mail watch with fingers crossed.
