Makes intrersting read..
Thanks! After the carry on yesterday I am trying to be a good boy today haha
But to be honest you were right - we must have one thing in common and that is to help others out. :T
Anyway, moving forward. The 7 companies are all indeed for profit organisations and are not government departments. lets clear that one up first.
This means if they have sent incorrect or adverse data to any lender or organisation (including the other members on this list, i.e. cifas) that has subsequently caused you pain, hardship or loss then you can claim compensation. You can also issue them small claims for Defamation of Character and Libel.
However before doing this i'd always suggest threatening it cos that usually works.... don't just go and do it thinking you'll get compo cos it isn't that easy! They will fight you tooth and nail cos if someone actually beat them, then the DPA laws will change forever and they would go out of business overnight that is why our mate UK26 is soon to be a national hero cos he's taking on Experian questioning why they retain data for 6yrs and questioning their integrity as to why they are even allowed to process our data, if they can do it so can you and I.....
It has already been referred to higher court and Experian lost in their strike out bid..... even though UK26 went alone and Experian took a top barrister.
Speaks volumes.... watch this space.2010 - year of the troll

You then get the documents, study them and compile one letter covering all aspects and cc it to each of the 7 companies so that they all erase the incorrect/out-of-date data simultaneously.
This way it should get sorted once and for all.
I agree but then assume that you would have to SAR all the compainies a month later to double check??Bank Accounts - Barlcays Premier[/B] - £1000 o/d, HSBC - £200 o/d- First Direct - £500

No. you will do it once and write to them, one letter saying the same but different companies. That way you know each one will get the same letter regardless if they have that data captured or not. This way anything 'pending' would be immediately dismissed.
You are also writing (when you SAR them) to the Data Controller - look at my template letter to see - who will deal with it personally. They are under strict obligation to follow DPA/ICO guidelines and their jobs are too much to risk so they will act correctly, 99% of the time of course.
Then they will write back to you confirming receipt of your queries advising they will look into it for you. They will then update everything and confirm in writing to you what actions have been implemented. Obviously you now have a letter (get one from all 7 companies) and if you ever get refused, you send a copy of these letters with your appeal and it'll generally be overturned cos that is the best proof you'll ever have that your records are accurate.
I've not advised what to do with incorrect data yet, i'll do it through the week and post a template letter to use because i'm still getting the facts together.2010 - year of the troll
