My credit card has not been refunded, I have had no phone call, have sent B & Q an email on Saturday requesting a delivery date (not much hope I know) but so far no reply?0 -
had e mail 29/1 to say they had done a credit transfer back to my card of the £94, still not there this morning, anybody had a sensible response from b&q re them breaking the contract and loss of bargain?sanfly0

There TOS clearly states they have not broken a contract (as does most retailers TOS). Their sensible response was the apology about a system error, and a refund of the monies. That is the end of it.The Head Honcho (does very little work)0 -

Companies write all sorts in the small print. Doesn't mean that it's legal and that is why we have a system to keep them in check. Often means no more than the current trend for a poster writing 'End of,' or 'That is the end of it,' to try and add some weightor authority to a thought that's popped into their head.Blitzkreig Bob says Hi to those checking his validity!0 -

Matt Wallis appears to be trolling now. Myself and others have put forward sound legal arguments on this thread as to why B&Q are in breach, but Matt just keeps repeating his mantra "you won't win" without actually citing any statutes or case law to back up his opinion.
Come on Matt, it's time to put up or shut up. Let's hear what you've got. Do you think all the laws I've cited on this thread (Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977, Sale of Goods Act 1979) are a figment of my imagination? Or do you think a county court judge would simply tear up all those laws and decide to invent a new one of his own?0 -
