Matt Wallis appears to be trolling now. Myself and others have put forward sound legal arguments on this thread as to why B&Q are in breach, but Matt just keeps repeating his mantra "you won't win" without actually citing any statutes or case law to back up his opinion.
Come on Matt, it's time to put up or shut up. Let's hear what you've got. Do you think all the laws I've cited on this thread (Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977, Sale of Goods Act 1979) are a figment of my imagination? Or do you think a county court judge would simply tear up all those laws and decide to invent a new one of his own?

B&Q have broken the law. The T&Cs that people have agreed to do appear to cover this scenario, however, the law clearly states otherwise and therefore there is a case.
If this is as clear cut as you seem to think then why don't retailers write T&C that remove their liability completely? Why don't Comet/Currys etc say "if your TV breaks then tough"? Simple..Because by law they have to fix/replace etc if the goods are still within their warranty period.0 -
