    The important thing is that mydeposits.co.uk are here to help you if you are a tenant. They would advise of the best course of action to recover your deposit and let you know what they will or won't do.
    Obviously, they are not obliged to help if they are no longer protecting your deposits.

    Getting money out of somebody is, as one sollicitor friend told me, one of the hardest thing one could do. If you are a tennant, using mydeposits.co.uk is an easy way out of this rentapad issue.

    Hi all

    I am sorry to hear of the troubles others have been through with Rentapad. I just got a call from my tenants who moved out 6 weeks ago informing me that rentapad have failed to return their deposit.

    I have already been through some grief with them - my wife and I moved out of the country for a couple of years in 2006 and rented out our house, RP managed to fail to pay us on time something like 7 out of 13 months. They overvalued the house in the first place therefore it was empty for 5 months using up all our savings, thus meaning that every time they failed to pay us on time we got charged by the bank and by the mortgage company as we didn't have any spare cash to cover it.

    I eventually recovered the 3 months rent I was owed and took control of my house back from Thom after calling MANY times - I think I just got lucky one day! I had driven up from London to Manc to get it sorted out and he then decided to give in during a phone call before I went round to see him. I am hoping something similar will happen so that I can help with my ex-tenants' deposit, I am interested to know if anyone has any tactics to sort this out.

    When we took control back of the house from RP Thom assured me that he would deal directly with the tenants regarding the deposit, and I was happy since I figured he couldn't mess with the govt scheme. Now I am told by the tenants that he supposedly removed it from one scheme and put it in another, but without any proof of it being deposited in the new scheme. There appears to be quite a good chance that he has used it to maintain RP's (or his personal) liquidity. In any case I will be calling often in an attempt to expedite the process.

    I had never found Thom to be criminally minded, just creative at accountancy, let's hope I'm right...

    Yep, repay your tenants' deposits yourself and then pursue Mr Doherty/Rentapad for reimbursement. There is no just reason why your Ts' deposit return should be delayed because the LA contracted by you, to act on your behalf, failed to act appropriately. Ultimately, the repayment of that deposit money is down to you as the LL.

    Sorry if that sounds harsh - it *is* wrong that some LAs seem able to fleece both LL & T and get away with it for months, or even permanently, but the T shouldn't be the one to suffer unduly in this scenario.

    "Creative at accountancy" is not a term that most people would use for those who end up with CCJs against them and fail to cough up.

    On a general note, failing to register tenancy deposits obviously comes under civil law, but not accounting for the whereabouts of the actual deposit money, neither passing it on to the LL nor returning it to the tenant, in the full knowledge that the LL will have to cover the loss doesn't come under "creative". Some might use words like "theft" and "fraud".

    Those who are truly "creative accountants" still meet their legal obligations and get the books to balance. Many might feel that an LA who can't/won't pass on rent payments to the LLs and who doesn't pay tenants their deposits back at the end of the tenancy looks very like someone who is either too thick to be acting as an LA, or is indeed "criminally minded", or a mixture of the two.

    I sincerely hope you will get your tennant's deposit money back from Rentapad otherwise you will most surely have to pay it yourself.

    I am sure you have read the various messages on this thread and know by now that there will be no easy way.

    The agent is your agent - it is your liability to protect and return it. Your bad choice of agent is nothing to do with the tenant. The tenant is being deprived of the deposit because you are not fulfilling your legal obligation.
    Do the morally and legally owing duty and return the deposit, before you incur costs being pursued through courts for it.

    Hi, yes I am aware of the legal aspects, although I dispute your claim regarding the morality or otherwise of my situation. Alas I don't have that kind of money lying around either. Fortunately my (ex-)tenants and I have a good relationship so I don't think we will be ending up in court somehow.

    I have emailed you various times about my issues with you! I'm still waiting for a response!

    I have been renting for 2 1/2 months now and you've been no where to be seen since we moved in - your service was brilliant until you had our money! Also, the fact that you still have one if not two sets of keys to my property is completely unacceptable. I felt it best to post on here, as I'm quite sure that you're reading this... plainly your office emails are being deleted!

    Also, I still have no lease.

    To all you renters AND landlords out there - STEER CLEAR OF THIS MAN - he's a conman.
