If you took out a credit card, loan or catalogue prior to April 2007, the executed agreement must be available. DCAs are getting cute but they have to provide it if they want to pursue you in court.
They have 12 working days plus 2 extra to provide it.
They can however enforce the debt later if they can find it.If you've have not made a mistake, you've made nothing0 -

i take it that you dont know much about legal stuff then? cos you wouldnt be so quick off the mark if you were knowledgeable about the legal aspects of the law in this country
also i do hope you never have the misfortune to lose your job , hope your many millions in the bank will keep your house and you fed and watered,,,, and thats me being rather tactful
any thoughts why they dont send consumer a copy of their paper document ie credit card agreement? i would like mine since ive been asking for a legible readable and fully executed agreement only since ehhhhhh oct 08

unfortunately, ive had the past year for me to become knowledgeable about my rights and no one is ever going to bully me or others again,,, and when i see postings that are duly not correct i will say whats there to be said but always in a challenging and positive manner - well as best as i can at the time ive read the posts,,,,oops,,,
i do apologise but i do really feel passionate about anyone having a pop unless they have experienced the difficulties themselves and say so in their postings otherwise i feel they are just trying to bring us down to the gutter level we are not even there even with our problems,,,,

legally in the UK, RMA do not have the right to phone 4 times a day. They have the right to be able to contact a debtor by one means. it is for the debtor to decide whether that is phone or letter.
legally, the OFT Guidelines require creditor to deal with the debtors nominated representative, which might include Payplan or one of the debt charities.
legally, if the creditor cannot comply with the requirments of the Consumer Credit Act, they cannot enforce a debt.
legally, DCAs are not allowed to make threats about legal action that they cannot take or to suggest that the debtor takes out addition debt to pay them off. It is very very common for DCAs to "suggest" all sorts of things that might happen. Now i am sure that you know that if someone is made bankrupt, their unsecured debts cannot be enforced by bailiffs? And that debt collectors have no legal rights and cannot take possessions, from the debtor, let alone other people living in a house where the debtor once lived?
Unfortunately, a lot of people here have been advised that these things are legal when they spoke to DCAs. As a rule, this is more of a problem over the phone because the DCA know that letters can be forwarded to the OFT.
And if court action is pursued, the debtor has documentary evidence of their attempts to arrange payments and of the advice they were given by the DCA. Unfortunately, despite the fact that phone calls are supposed to be recorded, when debtors complain to the OFT, OPs report that the tapes are very rarely available.
So we advise people to write or to tape all phone calls.
You will also be aware that the OFT has recently given 1st credit some very detailed advice about they way in which they spoke to debtors and wrote to them in the past, and are looking at other creditors?If you've have not made a mistake, you've made nothing0 -

That I also spoke to recently on the phone. Random, nope.
But, like I said, Maz same here, exactly the same as you describe this last year. The other factor here is I also have mobile broadband eg WiFi. Anyway, never mind. Probably random, even though it never appeared like it was. Except for the other 2 times it already happened here, of course.:D

NOBODY is 'glorifying' anybody - and, perhaps, you need to look at the real 'reason there is recession'.
I have reported your post as 'offensive'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi,
I've missed one payment on my MBNA Card
(actually I paid a reduced amount, told them why beforehand, and requested reduced payments for 3 months initially plus sent in a SOA which they have yet to accept)
and am now receiving letters from RMA. The letters seem to arrive at the same time as MBNA letters and, irritatingly, are standard letters which make no reference to the efforts I've made to get into communication. I note how they are increasingly threatening. I've now received a postcard from Mr C.Green saying someone will be calling this week. I assume this means visiting but from reading this forum it appears not!
I'm trying not to get too irratated with RMA as this is early days and I have to acknowledge that I probably feel awkward and embarrassed about being unable to meet the repayments so that's going on too. But i am doing the best i can to increase my income and I've had the credit card for years and never missed before.
I'm grateful for the opportunity to learn from others on this forum but need to try and take RMA at face value based on my experience and not be affected by the horror stories of others. I have requested that RMA only contact me in writing. I can't afford to ring them on their 0870 number as I only have a mobile phone.
I wrote RMA a 1 page letter yesterday restating my position and the fact that I am still 'negotiating' directly with MBNA. I do find that the time and energy involved in this detracts from things like looking for work. But I am committed to communicating with them - after all I did borrow the money.
In addition I think MBNA has a responsibility too. Based on my circumstances as was the amount of lending was probably not too high (just about) but the fact that they hiked my interest rate to 30%, partly in order to protect themselves, has had a major affect on my ability to repay.
I can understand how people can end up giving up and going to court etc. and/or into a DMP, oe veen bankruptcy, when full repayment might have been an possibility had they not been so exhausted dealing with DCAs etc. Perhaps I'm thinking ahead?
