    i know the feeling, just out of interest you say you requested your cca? with a 1.00 sent? so to date you have never received the aggreement?

    its against the oft guidelines to chase you if this account is in dispute if you have requested the cca and still awaiting for it, the legal date timeline is 12plus 2 days for postage to allow them to send you this information, its your legal right to have a copy, what you may find that if they dont supply they may not have an agreement or have misplaced it, you should check out the cca threads here for further info,

    im requesting all mine and ive stopped paying mbna because they have sent me an illegible cut and paste peice of rubbish - im now sending my complaint to the fos,,,, so dont be intimitated or scared to check out your rights,
    also they shouldnt have sent the debt onto other debt collection agencies again against oft guidelines if there is a dispute in place, like you not receiving your valid and executed cca

  • Thanks Maz. I stopped paying RMA once I had sent the letters and they never acknowledged my request. The fact that they have sold the debt on only confirms that they don't have the correct documentation.
    These DCAs don't scare me anymore, they are parasites. I feel sorry for the people who work for them. Talk about a cr*p job!

    Can anyone tell me what my first step here should be.....

    I got into trouble paying my minimum monthly repayments in january last year, and have tried to get my arrears up to date since. But the last 2 months have been very difficult, and I was going to pay the arrears in full this month, but have now recieved a text off RMA. My credit card company is MBNA, and I owe them around £5000, my arrears is approx £350.00.

    Do I call MBNA to clear the arrears, and will this then allow me to make further minimum payments directly to them or do I call RMA and pay off the arrears to them, allowing me to go back to MBNA and continue payments to them. Or am I now stuck in the claws of RMA??? Please ccan anyone tell me what to do??
  • I'd say pay MBNA as I like a lot of people don't trust RMA. If you want to you can then write to RMA and tell them what you've done. Don't talk to them on the phone and I would get MBNA to take your phone details off their records too.

    If you want to go further then look into doing a CCA to make sure that MBNA has all the right paperwork for your account.

    When I applied for my MBNA card, it was all online...so im guessing they will have all the correct details.

    Do you think my debt is still with MBNA or been sold to RMA?
    Im all confused as I have never had anything go this far before, and to be honest it is making me feel quite sick, but then thats my fault.

    Is there a way I can tell that it is deffinatley my MBNA account that RMA are contacting me about without calling them?? Will MBNA be able to tell me ?
  • The phone went this morning, think it was from RMA, but after a couple of seconds nobody said anything, so I hung up.

    I wrote them a letter, which was advised by the CAB, and they drafted me a letter which I copied, but they still to be calling. These people really are a bunch of morons as someone said, and also agree they don't listen to what you say. The CAB also recommended sending a copy of my letter to Barclaycard, which I might do.

    They are as bad as Mercers were, but at least Mercers did stop ringing everyday.

    RMA are the in house debt collectors for MBNA, so your account is still with MBNA and if you pay the outstanding amount it will carry on as normal.

    If you can't pay it then keep everything in writing and don't be pressured to agree to anything if you do answer the phone.

    Don't let the problem get to you, it's not the end of the world and there are others in the same or worse situation. Remember that to them you are just a number, not a human so treat them in the same manner.

    You've done the right thing in coming here for some advice and support. :)
  • I have recently had contact from this shower in connection with an MBNA account. I am currently deploying the tactics referred to by just about everyone else - but I am about to deploy another one which most people would never consider.

    In 1997 a law became effective in the UK which has some very unusual characteristics - known as the PROTECTION FROM HARRASSMENT ACT 1997. This makes the type of conduct employed by RMA both a criminal offence punishable by 6 months imprisonment, and it also provides the civil remedies of an action for damages in the County Court and also permits applications for injunctions to prevent the conduct complained of.

    Once RMA have been told you have no reason to deal with them and they make contact on just two more occasions you can legitimately get the Police involved, drawing their attention to the PROTECTION FROM HARRASSMENT ACT - and it would be as well to bring this to the attention of RMA and just see what their response is.

    They are hardly likely to turn up on your doorstep if it is likely to result in arrest for a criminal offence and an hour or so of interviews at the local nick !!   • Are they allowed to send out an "appointment card" ?? Just had one today saying they are calling on a specific day between 8 and 7pm. Scared!!!

    No. 'Home Visits' other than to establish that you are, indeed, the person they are looking for, should be 'by mutual agreement'.

    But don't worry. It is highly unlikely that anyone will, in fact, visit you - and even if they did, they would have no more authority than a double glazing salesman. They would have no right of entry to your house, whether peaceful or otherwise. They have no powers to 'sieze' goods, nor should they imply that they do. You are under no obligation, whatsoever, to discuss the 'debt' with them, and they must leave immediately when you ask them to:
