I've been paying RMA Resolve £30 per month for the last year or so, towards my £3000 American Express debt.

They have always been more than polite and understanding on the phone.

They have offered me £1700 as full and final settlement, paid over 6 monthly installments.

I have agreed to pay these installments as full and final settlement of the debt.

I asked, and received, written confirmation of the settlement arrangement.

Do you think this sounds genuine?

Any experience of settling debts with RMA Resolve??

Does the 'written confirmation' state that the £1700 will be "In Full and Final Settlement" of the account?

No other wording should be accepted.

DFW Nerd # 166 PROUD TO BE DEALING WITH MY DEBTS
  • Hi again. Finally got my complaint letter together after calming myself down since last post. Not sure who to send it to though, do I send to trading standards before OFT. Do I send to local office or is there a particular address. National Debtline told me to complain about MBNA as well as RMA. Confused and just want to post my letters. Grateful for any help against these muppets.
Found out we can't get caller ID in our area through Virgin but have programmed my mobile with their numbers so displays IGNORE when they ring!
  • I have found RMA to be polite and helpful - but only after my local Trading Standards officer intervened and threatened prosecution of both RMA and Amex for persistent harassment. Offer to deal with them in letter or via email. Get a new free email address from hotmail, googlemail or one of the others.
  • Thanks for info. I am adjusting my letter now. Will be posting it to Trading Standards. I have asked that I am only contacted in writing but RMA plainly ignore this. MBNA on the other hand just don't bother contacting me at all no calls no letters no reply. Still cashing my reduced pro-rata payments though. Maybe this will now push the boat along and they will either accept or decline my offer. At least I will then know what my next step is. I don't mind dealing with these people if they do it in a polite non abusive and professional manner, as of yet they cannot seem to do this.

I have just received a text from this company asking me to ring them on an 0870 number. Is this classed as a premium rate number for the purposes of the OFT Debt Collection guidelines? I have missed their calls due to work (meetings etc) or they seem to call me when I am driving. Should I phone them back?

Starting point for DCAs - do not phone them.

Always deal with them in writing. Do you know what it is about?

Haven't a clue - although I have recently written a series of pro rata letters to all my creditors. No replies yet though.

PS. I am writing this in my wife's profiles, so the debts on the signature aren't true - unfortunately.

In that case ignore the phone calls and wait for the letters.

They want you to phone so they can bully you.

have you requested CCAs for the older debts?

Not yet. I have started to get advice from Payplan though. Will they get these for me or should I do it myself? All the debt charities have virtually said that IVA is maybe the best route - I am £56,0000 in debt:confused: - and yes, I do admit its my fault. Combination of wife losing her job 8 years ago and me taking over her debts and now me leaving the Army and taking a £16,000 drop in pay (I'd rather be alive and in one piece than the alternative - too many near misses).

But to follow on from what you said, as I understand it, the creditors need to produce signed copies of each CCA for the debt to be enforceable - is that correct?
