    It is a misuse of watchdog and you are guilty of worse behaviour than you accuse CPW, Tescos etc...

    I have been charged for more than I authorised, not that I need explain my case to you, I sent them an email refusing permission to use my card details for more than I had originally authorised. but they still went ahead and I have received nothing!

    what am I guilty of exactly? innocently trusting a "professional" website to fulfil my requirements as they had stated they would?! Losing £89+ with nothing to show!?

    Well, i ordered a couple on Monday morning for family as xmas pressies, had the 29.99 notification through but nothing else. I have emailed them asking them to clarify the price before they charge my card as im not happy to pay anything more than 29.99. I havent heard anything back, so will see what happens.

    Have so far got no reply (other than automated) to my 2 emails asking them what the heck's going on.....have started the process of getting my money back from credit card company now

    says they try to reply in 24 hours and I've already waited longer than that....might wanna try calling? freephone number for sales 0800 1388696 then get 'em to connect you

    maybe we're going about this in the wrong way..

    ...instead of complaining that we haven't got the phone for £29.99 maybe we should say we haven't got our £15 vouchers that we've been billed for! ;) ;D

    1st time I've used them and it's been a disaster. Can't even be bothered to explain what's happened over the past couple of days.

    Good news is that cancelled order will be collected tomorrow (if courier turns up which they didn't today) and I'm being refunded the full amount they unlawfully took from me :)

    Bad news is that refund will take up to 15 DAYS!! >:(
    Will now be 90 quid short for Xmas >:( >:(

    Anyway, I may be angry but I've got to laugh, can't take something like this too seriously, life's too short ;D

    Its just a pain in the r's they could have honered us and realised it was their mistake! they wouldn't have lost too much money as only a few of us got them! (Not that I have received anythign yet!!)

  • Right people, having reviewed all the info I have determined that carphone warehouse will have no choice but to supply the phones (or difference to nearest competitor - "loss of bargain" etc) if:

    1) they have despatched the phones

    or

    2) they have debitted your card

    under their t&c's this is when the contract is formed:

    "The contract between You and Us will only be completed when We despatch the Good to You or commence the provision of the Services, as the case may be, or when We debit Your credit or debit card, whichever is the earlier"

    this would normally work in their favour because they would pick up the pricing error and change it when they despatch...

    but

    (note: you must also have the invoice stating the following - nec e616v @ £29.99 and 3 prepay voucher @ £15)

    on the invoice it states that the nec e616v is £29.99 and therefore they have to sell it to you at this price...you will find that the voucher that they have added to your order is non existent (because it is part of the e616v I presume)

    to sum up we have the following position:

    they have entered a contract to sell you an e616v @ £29.99 and they have added an item to your order you did not want and they haven't even sent you that item. this means you should claim that the voucher was not sent, and you didn't even order it anyway, and so the amount should be credited to your card

    i hope that all makes sense ::)
