    If he chooses to leave early that is up to him. staying to the end is also up to him. the deposit is a damage deposit to all intents and purposes. In my lodgers licence agreement it states that the deposit or part therof will be returned within 28 days after any reasonable, agreed damages (with receipts for work carried out) will be returned to them at their forwarding address.

    I hope you took photo's of the room before he moved in and certainly take them when he moves out please.

    Amy, you can't give him back the deposit until you have the specialist's opinion on how your floor came to be damaged and how much it will cost to put right. That is what a deposit is for, to pay for damage done by the tenant (if it was done by him). I know of an agent that kept the whole of a £1,000 deposit and told the tenant that it was because all the floors/carpets throughout the flat had to be professionally cleaned to remove cat hairs etc. (Tenant had a cat.)

    As to whether or not to reimburse him for his "unused" rent, that is up to you but say that you will send it on to him at his new address. You aren't responsible for him getting together a deposit for a new place, even if that is true.

    I hope that, if he asks you for a reference, you will not paint him as a perfect tenant, by the way.

    no i did not gave him reference. he asked for reference letter i wrote one which i think he did not like as he bined it. i just said that most part of the agreements were not respected and mentioned the ones not respected. after he is gone tonight he is not my problem anymore. i am just glad it is nearly over and can not wait for tonight to change the lock once he is gone :) yeppeee.
    i just need now to calculate the bills for tonight and do the inspection of the room and his bathroom. i have mentioned on my notice letter that the room should be cleaned prior to inspection so we will see if this is done. if not i will keep some money to have it cleaned. cos i am not his maid! room + bathroom were in neat condition when he moved in so i expect it to be returned the same way. he managed to scratch the floor again yesterday and all i heard was !!!! not even sorry or nothing well he is gone tonight and i will be happy.
    for the rent i will keep it and i will tell him to come back for deposit friday eve after floor company came. it is only 2 days delay for him as i am not sure what happened to my floor then i prefer to be on the safe side. i will start looking for a new lodger but i am quite scared that once again people say yes to everything when they view the place and then don't respect the rules once they are in. so i will probably have a landlord from my estate coming during open house viewing to make sure that this time i take the right lodger.

    Well, you don't have to write him another or different one. He asked for a reference, and you gave him one.

    You don't have to give him his deposit back that quickly either Amy.

    Like i said above, you need to do a room check when he has handed the keys back. You might find other damage which you are not currently aware of. You will need a written estimate from the flooring company too - all takes time and you legally have 28 days anyway.

    don't let these people bully you.

    as for a new lodger, be firm with your house rules. if they get a whiff that you are a bit of a softie then they will take the p1ss.

    well he is out and locks are changed :) tada
    he asked me to come back earlier than time agreed as said he locked himself out which was not true as he had keys in his pocket, which is childish as he could just have told me hey i would like to leave earlier than agreed can you come earlier please. i would have said yes but he made me leave work earlier as pretended to locked himself out of the flat.

    it did not go without an argument

    he damaged the wall (huge dried stain) and had the cheak to say he did not do it when he did i have picture of room before he moved in to prove it. so i kept the month rent and deducted bills from deposit. he was not happy about paying bills either. don't care i did not gave in and kept money for bills.
    he still wanted month rent back i told him he would not get it.
    he was quite rude with me asking why the f..k was my neighbour there for? i just said to change the locks.
    he had a friend over when i came in the flat so i had my neighbour.
    if my neighbour had not been here it could have turned sour so all went pretty ok minus a few threats and not taking responsabilities for damaging the wall. but he is out so i will repair my wall and clean the whole place
    i feel relief. thanks all for your help and i will be way more careful on who i chose next as a lodger. :rotfl:

    Sounds like he's not going to get a penny back - as you have to redecorate the room. (Paint one bit and it all needs doing)
