    am going to have a look again
    as i need to be careful,anybody can say what they want in the interview and then do the contrary once they moved in. so i will read all the tips to make sure i dont get bad lodger again :)

    I have a list of house rules which they get given with their license agreement. they have to sign copies of both, i photocopy them and give them one so they can't say they haven't got one.

    I have learned by bitter experience though when a smoker says to me that when they say they will smoke outside, that they may not do that so I now won't accept smokers at all.

    he paid his rent for January at begining of the month
    i gave him a month notice
    should i give him part of the rent he paid back for the days he is not using?
    cos i thought that a month notice meant that if you left earlier the landlord was entitled to keep the rent? no?
    should i give him some rent back for the days he is not using? cos this is what he wants.

    its up to you - if he chooses to leave early that's his choice and you can keep the rent.

    However if he says he'll stay to the end of the month if you don't refund him then you choose to either live with him and have the cash or live without him and not have it.

    well i though the month notice was to protect lodger not to end up in the street and to protect landlord not to be at loss either.
    tricky one as i surely dont want arguments but then dont want to be at loss either especially when my floor has been damaged and i dont know how. specialist of floor company comes 2 days after he leaves. and i dont know what happened to my floor as was not there

    If you want him to pay for damage he's caused tell him how much it'll cost and deduct it from the deposit and give him back the bit he doesn't stay for.

    not sure it is him as he said it is not. and i wont know for sure until company comes to see what could have caused the floor to be this way.
    and in a way i gave him a month notice to make sure i would not lose the rent he had to leave on 01/02/09 and now he does not respect the contract and expect part of the rent back.
    he did let me know he was leaving 4 days prior to date he is leaving so should i give him part of the rent back when i gave him a month notice cos for him he is accomodating me by leaving earlier?
    if i tell him tomorrow i keep his deposit until friday that floor companies comes we are in for a huge argument so i don't mind giving him deposit back minus bills but keep the rent so that i can pay part of the repair of the floor with rent money as floor needs to be changed in the corridor as totally ruined

    Yes tell him you'll return the deposit after you've found out how much the repair will cost.
    Ask for his forwarding address.

    Sorry im not a landlord or rent(er) but from what you just said, no I wouldnt give him anything back as you gave him the correct date and notice to leave and that was upto him to leave 4 days earlier, you did not tell him too.

    Just spoke to a guy who has a business renting flats and he says no, you dont have to give anything back for those 4 days as they paid for that time and it was their choice to leave, they can keep the keys for those 4 days or hand them back to you but no you dont have to refund them. xx
