Basically, you had a contract with this guy to sell him your car at the price agreed, and he paid a deposit to secure that agreement with you.
If you back out of the deal, he would be within his rights to buy a similar car for the best price he could get and if it was more than he had agreed with you, he could sue you for the "loss of bargain" (the difference in price). As far as I know.
However, as part of the deal was that he would pay the remainder of the balance, today? yesterday? whatever....... anyway, he failed to pay the balance as and when agreed, so the original contract is now void.
He has probably said to you he will pay the balance on Monday. The question is, did you agree? If you did agree, then you have entered into another contract. And the same rules apply as did in the first contract.
You could argue that you did not agree to the new payment terms, and phone him tomorrow telling him that you consider the deal to be off, and that you will return his money.
Practically speaking he's not gonna do anything if you pull out and say the deals off. It would be very difficult for him to find a similar car and claim a loss of bargain from you.0 -

As he drove 200 miles to see the car, that's 400 miles "round trip" (an americanism I believe). I think you should give him his deposit back plus his fuel costs for the 400 mile trip. And make sure you tell him on the phone ASAP that the deal is off and not to come on Monday.0 -

my first thought when i read the OP,s post was that he sounds american, nobody uses the term "title" in the uk.
i think theres a few people on here being a little harsh, i think hes got himself all worried about the situation and just wanted some advice. Mine is.......sell to the second guy if the first is messing you round and you dont feel happy about him. He hasnt kept his side of the agreement ,so in my opinion, that cancels out everything, give him his money back, sell to the second guy, give your mother her money.sorted0 -

next time I ask any question on a thread I'll make sure it dont say UK in small letters on the page somewhere

It may have been helpful to have said your country of residence in your opening post (over here 400 miles will get you from one end of the country to another).
