sold a phone on ebay - buyer having me on!!! EDIT: Now he's opened Paypal Dispute

    He will need to send it by trackable means, as he will need to show that it actually got to where it was supposed to, but be wary of any strange evenvelopes turning up that require you to sign for them.... I have a feeling that he may not send the phone back, just a piece of paper in a recorded envelope.

    If he doesn't send it trackable, then you can claim you haven't received it, and he'd have no way of proving otherwise.

    And he'll also have to send back the SAME phone he sent to you (which he might have already sold on as a reconditioned phone), so it'll be interesting to find out what happens!!

    Can't believe ebay sided with him. They really do employ some stupid people.

    I have emailed ebay to support the sellers getting ripped off by this idiot. I bet they dont even read it. :rolleyes:

    yes Little miss cheeky is another one who's been 'had' buy this guy. LMC, in answer to your question I havent contacted EBAY yet, because to be honest I dont know which part of their 'contact us' i should use. Every subsection i go to on their help section is irrelevant to this scam. How do I report this user? Im not hopeful Ebay will do anything to be honest. They usualy jsut send out a standard auto response and thats the end of it.

    Have you tried the live chat yet, as they often seem to have more common sense than any email response you'll ever get?

    Get someone on live chat to look into it and perhaps that might help?? (but probably not, this is ebay...)

  • I'm not sure there's much you can do now until you've recieved the "returned phone". If it's easily distinguishable from yours (including empty envelope), then you have a clear case to fight. In the unlikely circumstance that you do get your original phone back, no harm done.

    The official line is always "send it back for a refund" - that's what you offered, and what he refused. Now Paypal is effectively enforcing that by saying "yes mate, you will send it back before you get your refund".

    We're all predicting that the guy's going to mess things up further, but you can't dispute Paypal's decision based on a prediction - as frustrating as all this is, we have to wait until he makes his next move :wink:

    I used the option obscene language as its the only one that actually let me email rather than redirect me to an information page.

    I don't know which one to use either.
    Maybe if we both Email ebay and tell them his seller account as well as his "buyer/rip off" account they will surely have to listen.
    He also owns a business where he lives. That's the address he uses for his "buyer" account so may well be that his seller account is under his home address??
  • I just sent ebay a message under "misuse of ebay" sub heading "protecting my paypal account"
    Here is what i put.........
    This is the second time i have contacted you about this buyer/seller.
    I don't know which section to Email you under but this looks like the most relevant.
    Buyer ID hallmark_imaging is buying faulty phones from ppl and claiming different extra faults, eg. broken screen etc. in order to get a partial/full refund. He then sells from a different account ID carlidanielle
    Ebay should be protecting their sellers from scams like this. Why don't you contact some of the other ppl he has sold to where he has left feedback such as "initial problem but well sorted" and ask them what the "problem" was? It's fairly obvious what's going on and ppl are going to be reluctant to even sell on ebay if this is the sort of thing that you allow to carry on.
