Regarding that second email, I smell a fake!
All emails from them start Dear Apple Store Customer
and end in The Apple Store <- note the space!

The email is genuine, sent from an Apple IP address and sent to an address that (in my case) only Apple have. It was probably typed up manually by whichever IT drone messed up the batch mailing. :)

What the **** are Apple upto I can only guess that they are running around like headless chickens. The right hand doesn't know what the left hand is doing.

My order is stilll there saying Not yet shipped and the funds are still allocated from my account. What a c**kup why can't they just admit they have ****** up big time and apologise and offer a goodwill gesture. At this rate they are going to create a customer relations nightmare IMHO

in all fairness i knew it had a small chance of coming off but feel more aggrieved than others beacause my money has actually come out of my account compared to those whose money has been set aside

i am dangerously nearly out of cash and payday is friday

it sucks b*lls to be honest

ive also submitted a letter to watchdog displaying my disgust at how apple have treated us the consumers. what they have done has imo has given them a bad reputation and by not offering any goodwill gestures or apology for THEIR mistake will only prove worse if the news or watchdog catch onto it. apple better get their acts together and give us what we want!

    Hum

Me thinking. Is there anything to stop me ordering 2 full priced cameras. Then when they appear either telling Apple they made a mistake or going back to my credit card company with the original invoice?

Just a thought. Anyone tried this or reckon it'll work. What have I got to lose?

"On the 27th Dec 05 I ordered a Olympus SLR E1 from you UK education site for £98. Within 20mins the money was taken from my bank account and Apple UK agreed a sale contract with myself.

On 3rd Jan 06 I received an emails stating that this item was no longer in stock and all orders would be cancelled.

When I phoned UK customer services they stated that the camera was discontinued and was not available. I did not believe this and spoke to Olympus UK and they stated that they have stock. I recalled UK customer services and alluded to this and was told that it was a mis-price, but I could buy the camera at the original price of about £650.

The conversation was had with customer dervices and she was told that it was being recorded for legal purposes. In it she stated that, “The cameras were withdrawn due to a pricing error; they are not available at that price, but will be at a higher price.”

When I told her that this contravenes your UK Terms and Conditions and she said “no contract is formed between myself and Apple until they take payment.” Unfortunately my bank shows that the payment was taken – therefore the contract was formed and the order confirmation was sent by Apple UK as proof the contract was made.

I believe, with my solicitor, that we have been misled to buying an item off your UK site under false pretences. The order confirmation showed a discount of £425.97 therefore it could not have been a mis-price.

As a Student entitled to buy from this education site, I would like to receive the camera, or that of equal specification to satisfy the contract under taken by Apple UK and Myself."

Okay EVERYBODY visit this link, and write a formal complaint. It takes two seconds to do, and I've included my complaint to be used as a template. Its not perfect, but it should cover everything.

    http://www.bbc.co.uk/watchdog/contact/onlineshopping.shtml

The more people that complain about this, the more likely we'll get Watchdog onto Apple's back.

"On Dec 29th, I ordered a E-1 Olympus digital camera from Apple's online education store. The order was confirmed and the money credited.

However today (Jan 3rd) I received an email informing me the order has been put "on hold" and will be cancelled, as "the product is no longer available". This is odd, as the camera is a current model according to Olympus. While this sounded ambiguous, I now understand it to mean Apple have cancelled the contract.

According to the ToC, the contract begins when an order is confirmed, meaning a contract made been made.

The product was advertised as in stock and available for dispatch within 24 hours, and by failing to honour this, I believe Apple to have committed an unjustified breach of contract, especially considering that I am more than willing to wait until the product comes back into stock. "
  • Have complained to Watchdog also.

I think it is very important that companies realise that they have to ensure that they honour contracts.
