How about you do it mate..? You're posting up a lot of stuff about "so-on-so should do this/that/the other" if you're incensed enough then do something yourself.

I called earlier & had a pleasant conversation with a person, not a faceless rant via email.

The invoice is totally relevant! In the terms it says the price you will be charged is the price on the invoice.

No, you are missing the point. I was talking about whether the original description on the website could be considered believable (such as Kodak's) or not (such as Argos') - this has nothing whatsoever to do with the invoice.
Time is an illusion - lunch time doubly so.

Just wondering; my Order Status has left limbo and is now showing as cancelled, anybody elses the same?

Corporations don't act on generosity or how pleasant your converation was over the phone, they do whatever they perceive to be the least painful option.

In the case of Kodak, they decided that informing 3,000 or so people would cause too much negative publicity, and opted for the easier option of "the customer is always right". That was done after the teeming thousands customers set up websites to show how !!!!!! off they were.

I don't know about you, but I don't think a "pleasant" conversation would quite have the same effect.

But I'll take your other comment on board, I'm more than happy to write out letters or whatever I can do that is useful. I only suggested someone else do it as I believed there were solicitors here in a far more qualified position to the deed than me.

nope mine is still saying still to be delivered.......

i think the next email we get from apple will be an interesting read.
I assume in it they will have tio justify thier position in such away as to fufill the original T&C's as somone just posted ......

2.6 Whilst we will make every effort to supply you with the Products listed on the Order Confirmation, there may be occasions where we are unable to supply these Products because, for example, such Products are no longer being manufactured or we are unable to source relevant components. In such circumstances we will contact you to inform you and may suggest alternative Products that you might wish to purchase. If you accept our suggestionsthen we will send you a revised Order Confirmation. If you do not accept our suggestions then we will cancel your Order in relation to those Products we cannot supply and repay you any money that you may have paid to us in respect of those Products. Repayment of such monies will be the extent of our liability to you if we are unable to deliver to you the Products you have ordered.

i assume that if they try to offer an alternative it has to be at a similar discounted price ......either way they have to go through these motions to comply with thier own rules.

Given we still as yet await this email I can only still think that in apple house thier is still much gnashing of teeth .

Well Apple haven't claimed the price was wrong, only that they were out of stock.

Even if the camera was worth £600 and was marked down to £100, it isn't an unreasonable offer. Remember it was a relatively old camera with many better DSLRs available for cheaper (I just bought a 350D for £350). It may have been on offer and, most importantly, was being offered to students or those in education only. Now I know microsoft have been known to reduce the price of their products by such margins when offering to those in education.

When you combine the three of the above, the price it was being offered at wasn't improbable. But anyway, that isn't the reason why our orders aren't being fulfilled.

And I don't buy the apple line for one second, they are claiming that they have NONE in stock. Now if some of us managed to get cameras and some of us didn't, then that would be believeable, but according to them they have NONE in stock.

    BULLSH*T

Now the reason for the delay in getting back to us is obvious, they were busy contacting their legal department trying to find a way to prevent themselves from getting raped. Must have been difficult for them to find a get out, and this is the best they can come up with.

No reason to roll over and play dead, we should make as much noise about this as possible. It happened with the Kodak case, and and quite possible could happen here. We need to create template letters of complaint, to send to watchdog and advertising standards, and any other relevant body. One legal eagle composes the letters, and we all send them in.

    Any volunteers?

That is the most constructive post i have read since apple sent the cancelation emails out.
I totally agree that we need to join forces and write up a formal template letter pointing out apples' legal obligations to fulfill the contract of sale, so that we can all join forces together.
This would be made easier if any of us who have any proffesional background in consumer law could contribute to getting this done. I have kept printed copies of my account details, t&c's (old and new!!) and will be taking these to trading standards. I will post the response i get from trading standards when i have spoken to them.
Apple know they are in the wrong, which is why there are such conflicting stories coming from apple CS. We must keep up the fight in a constructive manner and avoid getting worn down by their attempts to dismiss the contacts of sale so easily.

I've just spoken to Apple's CS. Initially I was told that I should have been emailed on friday regarding the orders being cancelled. Then the girl changed her mind and said monday, then I told her the email actually arrived this morning, and she said that that was it.

I spoke to her boss next, and he said that the cameras were out of stock and no-one would be getting them. Then upon further questioning, I was told that the cameras shouldn't have been available to buy at that price, so I told him he was now saying it was a pricing error, and not a stock issue, to which he replied he didn't know. I then asked to speak to his manager, Anne Goggin if anyone wishes to contact her. She is the customer sales manager.

She is supposed to be calling me back sometime this afternoon, so I'll let everyone know what happens next.

All I want is an honest explanation, and an apology for taking funds from my credit card if they are unable to supply the goods! I'm not expecting to get the camera, and never did, but I do expect some honesty from a company!
