Well everyone on here is telling you YOU are in the wrong, and you are still arguing so there is little point in me saying the same as all the other posters.
As far as Ebay are concerned YOU are at fault 100% as far as all the forum members here are concerned YOU are at fault 100% If it was me I would report you give you the lowest feedback possible and give you a neg as well, so lets just both be happy I have never bought off you.
I have 100% feedback and like Ive already said in 4+ years ive never been in this situation0 -

Thankfully, the way I see it is in line with English Contract Law, Ebay's rules and Paypal's rules. It's also the morally right way to see things. I hope your buyer sees senses and files a paypal claim against you. See how Paypal sees this...In a rut? Can't get out? Don't know why?

Got it yet? You chose not to send it by recorded delivery. The buyer doesn't have to choose anything, as it's not your buyer in a contract with royal mail. You're the one with the contract with RM to delivery your item to the buyer. Failure to get it delivered means YOU are in breach of contract with your buyer.
I don't believe you are a dishonest seller, but I do believe you are a bad seller.

It is not what you think that matters. It is what ebay and paypal think, afterall, you signed up to their T&C's and those T&C's say you are wrong. Continue down this path and you will get a claim against you and negative feedback.0 -
why not post the buyers ID or PM it to me if you like
i will then inform the buyer of their rights
then we shall see how they feel about a 50% refund when they are entitled to 100%0 -

Previous post that some people on here dont seem to have read:I have thought about it if I were in her position, thats why Ive offered to go halfs. I doubt she'll take it though since shes entitled to the whole lot but I feel Ive lost a CD that I cant resell and I have to pay her back for it because she choose not to use recorded delivery.
I didnt realize that she would still be entitled to a refund if it got lost using regular mail.
Now Im on the 'other side' of it I feel like theres not a lot to protect the SELLER in these cases.
We'll see what happens, and it is a lesson learnt. Recorded delivery from now on lol0 -

How is that relevant?
There is a simple way a seller can protect themselves against this; use an online trackable method of delivery. You chose not to protect yourself by trying to palm that responsibility off onto your buyer. Sorry, love...it's not your buyer's problem. It's yours.
Post your buyer's ID and let someone here inform her that she's entitled to a full refund. See if she's still willing to go halves with you.In a rut? Can't get out? Don't know why?

Yes, it tells me that some people are out for all they can get.
I was going to refund her half now, then the rest in, say a month when its clear it wont arrive.
Not everyones as lucky as you, I cant afford this. Or pay extra out of my own pocket for insuance.
A few weeks ago, a buyer decided she had to have something I sold 2 days later I told her I could post using next day delivery. She said she'd Paypal me the extra once it had been posted. And did she? Nope. I paid £6 extra to post something else, because it was heavy, did I try to get this money back? Nope. I go out of my way to help people, regularly. But I cant do everything for everybody all of the time. How ignorant of me :rolleyes:0 -

And we've sorted this problem thank you. She knows what shes entitled to, which is why, earlier in the thread i said I doubted shed go 50/50 but thought it was worth a try.0
