We got our Notice of Court Action today from Newlyn too - to anyone who isn't even aware of the background to them and their cronies, some points immediately stand out in their letter...
1. Letter states it is a Notice of Court Action - it is NOT. It is simply a letter stating that Newlyn are going to pass your file back to their client, presumably CEL. Any actual notice of court action would presumably have to come from CEL as they would be the ones taking you to court, not Newlyn.
2. The letter does not even state who Newlyn are (wonder why lol). If they were in any real legal capacity they would say so.
3. They kindly offer another 7 days to pay before passing file back - smells of desperation one last try before they give up.
As always - IGNORE !0 -
Just recieved next letter ( rather daughter has) from Newlyn, notice to county court proceedings for total outstanding £238.13.
I can understand how recieving this letter can sit uneasy with some people.
stating that because failure to pay 'may' mean being registered with county court thus allowing baliffs to remove household effects and cars from your property and also affect your credit rating,
threat is quite intimidating.
It does make you feel uneasy when first recieving it, but thanks to this forum I knew it was comming and you do look at the letter with its cunning wording and start to pick it apart.
As others have posted it states 'MAY' now be registerd, why not state you will be if this is the case, and 'this action will allow baliffs' is a loaded statement as even if it went to court there is no sure way of knowing that they would win.
I hope that by posting an update everytime my daughter recieves one of these letters I can help others not be so fearful.
Surfice to say ,we will be ignoring this latest letter as well.0 -
Apart from ignoring the scammers, some of you might like to report them and their debt collectors for harassment and chasing an unenforceable debt (the 'alleged debt' is a nullity as it has no credit agreement of course, and no contract has been entered into).
See this link for ideas on what they can and can't do, what can constitute harassment and what you can do about it - and where you can report them (Trading Standards, the OfT, your MP, etc):
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=03_harassment
Also, do the original PPC letters - and the debt collector letters - state a VAT number? If not then report them to HM Revenue & Customs. If yes then check the VAT number with HM Revenue & Customs (more than one PPC has used a false VAT number, one clamper uses a VAT number on their stationery that belongs to Barclays Bank! See here, scroll down to 'how to check a VAT number is valid' and 'VAT fraud':
http://www.direct.gov.uk/en/MoneyTaxAndBenefits/Taxes/BeginnersGuideToTax/DG_4015895
And if either of the letters is from a Limited Company, then they have to state their company number and name/address on all their letters:
QUOTE
What details are required on a company's letterhead?
The full company name, registered number, registered office address and place of registration (e.g. registered in England and Wales) must be shown on all business letters, order forms and websites.
QUOTE
If not, report them to Companies House, see here:
