    But they don't HAVE to pay. They can and almost certainly do decline delivery of the stampless mail

    Here's two or three bits which haven't been touched on before as far as I can see.

    Civil Enforcement/Newlynn and the dreaded Coppins Bridge car park - I was driving, the car is in my wife's name. I think there may be 3 separate incidences, I haven't checked the dates. On the first one, I wrote and owned up to being the driver - this was before doing any research. I confess I engaged with them, then did a bit of research, and threw some counter arguments at them - they got irritable at dealing with questions really quickly! I am now waiting to hear something... anything...

    In the course of this, I said that my contract was with the landowner so, if they'd tell me who it was, I'd send a cheque for a fiver to cover their actual loss as a result of my breach of contract, and they said that it wasn't their policy to disclose details of the landowners they were acting for. I figured that would make it a bit difficult for them to take me to court, then, since it would be the landowner who would have to sue me. If nothing else convinced me that this is no more than simple intimidation, that did.

    Lately, they've been writing to my wife as registered keeper (not sure if it's the same one - it may be one or both of the later ones). She's a bit more antsy than I am so I did a letter for her saying that she wasn't the driver, and they've thrown back the threat of a Norwich Pharmacal Order to make her produce that information. I don't for a second think they will, but it is a tweak I haven't seen mentioned before.

    You may safely ignore that claim. Whoever wrote that is, frankly, delusional.

    A Norwich Pharmacal order is a procedure whereby it is possible to find out the identity of an alleged wrongdoer. The principle originates from the case of Norwich Pharmacal Co v Customs and Excise Commissioners [1974]AC 133, 175, HL.
    Mere witness rule
    Some who observes the facts giving rise to a cause of action between two other people can be called as a witness at trial. A witness can be compelled to attend to give oral evidence or to produce documents by serving a witness summons. But, until trial, the witness can refuse to answer questions and to disclose documents.


    Wait for your court date which wont happen in 99.99% of cases, but until then IGNORE.

    Dont pay Private Parking tickets - they are mere invoices.

    Why would any sane rational person want to pay for advice when it is freely available elsewhere? This site, pepipoo, CAG i could go on.
