    As dad took it out over the internet I think he must have had a box to tick, but they must have asked if he was self employed surely, the only way egg gave statements was over the internet so as dad forgot his password he could never get in to see what was going on. he worked long nightshift and being tired all the time, not being very computer literate left it and just paid with a standing order both together the loan and PPI. he has rang them today for all his original agreement and they are supposed to ring him back with the insurance phone number but haven't as at 5.30. he is going to the CAB when the paperwork comes.

  • Sorry to hijack but cogs in the brain are on overtime tonight :D

    If I asked MBNA for the true copy of the cca for a £1 then this would show the different pen ticks wouldn't it? Seeing as they have proven that they have the original to give it to us then they cannot refuse can they?

    Also I think we have a good case that OH wasn't fully covered the same as a employed person as they have stated in their response letter that certain exclusions may apply for a successful claim yet it was up to us to decide whether to continue paying for the ppi on the card when you received all th ebumpf that comes with a new card.

    This was not stated in any letter until now. If OH knew that he wasn't covered unless he was declared bankrupt or his business ceased to trade because it couldn't pay its debts (he doesn't own the business) then he wouldn't have paid into it for this long, he would have cancelled straight away.

    Also we are on a dmp and have had to make reduced payments by the time CCCS has kicked in and missing a few minimum payments means he had defaulted on the account therefore making the policy virtually impossible to claim on anyway. If he had lost his job the account would have been in arrears, he is not entitled to claim jsa as he has not paid voluntary class 1 contributions.

    I am feeling very hopeful about the ppi fight but can someone please clarify if I am right to go ahead to reply to MBNA with the points above to see what they say even though they have replied its their final response?

    Toffee Penny, if the account is closed or nothing owing on it then you can only request a copy in the SAR and this is all you can really get. It states in the CCA under section 77/78 about requesting agreements that you can while there is a debt owing and you pay £1 but if the debt is settled then they do not have to comply with that section.

    I would think if you can get this complaint to the FOS then they would see that the tick is someone elses too.

    Were MBNA a bank and part of the Banking Ombudsman or were they members of the GISC at the time of your loan/credit.

    If they were then you could send the complaint to the Ombudsman and they look at it if you only JUST recently became aware.

    Also if they have sent you a final response its doubtful now that they will respond to you again.

    I will be back and forth tonight folks, in-laws are calling in for a cuppa....:eek: , so I have been dashing about cleaning here and there, just to make it a little more tidier.....:D , think its sometime after Eastenders they will be calling in.;)
