    This is for misselling and not rebate so you have to write to whoever actually SOLD the policy to you being Firstplus and also cause its December 06 you should win. ;)

    The FSA took over the regulation of insurance since 14th Jan 2005 and they had rules to follow and most of the time FIrstplus did not. I feel really confident for you here. (and not just saying that either!!)

    Hi Guys,

    I am trying to get PPI back form Ocean finance for 2 loans in 2004.

    This seems to be the problem as the FOS didnt regulate this company till 2005.

    Surely there must be some way of re-claiming PPI from that date, but how?

    Any advice greatly appreciated

    Had a response from MBNA today to say OH ticked the box on his application form requesting ppi. They have actually sent a copy with the tick in the yes box highlighted

    BUT

    I think it is in a different pen, every other detail on that form is the same kind of writing from the same pen ink yet the tick in the yes ppi box looks a bit different to other ticks.

    I don't think OH ticked that box on the application form, they also state in their letter that self employed is covered but there are certain criteria that must be met in order for him to claim. Well they didn't state this before when he opened account, the application form shows he ticked self employed as his status.

    There will be no refund at it was up to OH to read policy etc and this is their final response but because he applied in 2001 we are outside the time limit for referral to the FOS

    So now what? Any ideas please? :confused:

    Toffee penny, forget that they say that about ticking the box and also that this is outside of time for the FOS. If you only just became aware then certain rules can be applied by the FOS providing they were GISC members or in the old Banking Ombudsman Scheme

    Will be back on later as just cooking but wanted to catch you

    Did you use a broker or was Ocean Finance the broker/lender..??

    If they were not regulated until the FSA took over have you checked if they were members of the GISC (General Insurance Standards Council). You can do this by ringing the FOS and asking them about this and give them your dates and ask what date (if they were!!) they became members.

    I tried to use the ombudsman, but they told me they werent regulated by them or a member of the GISC at the time.
    Seems strange to me that no-one had any jurisdiction over them in 2004

    Hi Mike

    Like Marshallka have already asked, did you use a broker who arranged this or was it them of Ocean finance that arranged these loans for you?

    Double check on this and let us know cheers, we can then check out if they were regulated as such.;)

    For one of my loans then for instance, it was a broker called Click finance who arranged the loan but the lender were Nemo.
