I am not the one for maths or calculations, here but I am sure Marshallka, or someone will be able to help if you want something worked out for you.
However, if you have settled a loan and was mis sold, they should put this right as if you did not have the PPI from the start of the loan, plus contractual interest and 8% of what a court would award.
If the loan is still active, they may offer to reduce the loan and have less repayment to pay back.
For instance, my loan was settled, the loan PPI alone was that of over £10K, they repaid me back for the amount of just under £13K, that is with the interest, hope this helps.;)

Also if this comes to a positive result the ppi should have never been sold to me so surely First plus would lose a complaint for unfair rebate. If mis-sold surely I am entitled to a 100% rebate and if first plus deny any accountability it would be that the broker would be liable to the interest on the 10800 for 18 years. If not I would still be greatly out of pocket? Section 36 and all that would surely mean they are responsible for their agents actions seeing as the insurance is underwritten by Barclays insurance in Dublin.
I suppose the best thing to do is try to explain this to the ombudsman if, as we think, we get the result we deserve!???0 -
The thing is First Plus are denying any responsibility in the matter laying the blame at the brokers door. Our complaint is with the broker(for now). So after settling the loan we are paying interest on 10800 which was used to settle the ppi after 5 months. The second loan was arranged through the same broker. If the ppi had not been mis-sold to me then I would not have had to borrow the further 10800 to settle it.Then pay interest on the sum for 18 years.

Yes I see your point here hun.
I think you have a good case here, Marshallka has had problems with Firstplus and being from pillar to post with these, again regarding an unfair rebate.
Who is the broker hun?
It is normally the broker we have to write to on the mis selling side of it, and there is an issue on who to pursue with on the unfair rebate side, especially as Marshallka's were taken out before the company became regulated sort of thing.
I think Marshallka could explain this one better than me to you and she is still battling on this complaint now which is with the FOS as well.
There are so many complaints about Firstplus currently and I believe the main of the complaints in with the FOS are mainly about this company.
They are not easy to deal with but I think you will end up with a good outcome with this.;)
Marshallka will be back at some point tonight I expect and will also reply to your post, so check on here now and again hun for any updates, and by refreshing your page now and again in case any posts missed.;)

as stated on your letter dated XX/XX/XXX) if by letter.
I feel you have had ample time to pay me this cheque owed to me, and now I am requesting you send this to me within 14 days of date on my letter, or I will be forced to take further action.
To avoid further action being taken, I expect to receive the cheque payment within 14 days and would appreciate it if you send this by recorded or special delivery in order for it to reach me safely and for me to sign this item, thank you.

The broker was Norton the FOS are now giving them 14 days to reply to his findings.They have said we should have an outcome by the end of Jan.0 -

If your requesting for just the CCA, you just write to them and they have 12 days to send this to you, you enclose a £1 cheque payment for this request.
I have never used a template for this one hun, unless Marshallka has one otherwise, but if you want to request the whole lot of info about you then you would have to request a SAR.
Is this the one you mean hun?
They have 40 days to comply on the SAR and 12 days for the CCA.
I will check the site for any template on a CCA just in case, but I think many may just request this just by a simple request.
