If they called your bluff they would be extremly stupid. You would not have to go to court I would help you with moneyclaim on line.
As I say they owe you money and should at least give a timescale as to when it will arrive.
Each time I have claimed money I have been told 2 weeks, 4 weeks or whatever.

Di on here had to send a letter for one of her claims , Di if you see this what did you write?
FOS give them 5 weeks for the money before they will get involved...;)

    Hiya hun

I have not had the chance to read the posts thoroughly as the in-laws are here, but I take it this is regarding waiting for the money to come through that have not yet come through.;)

I did have a letter done for me by someone over at PAG, and thought I saved it, just had a quick look now and cannot find it, however, this is called a letter before action (LBA).

The only other thing I suggest really is to write to them and tell them you expect the money (Cheque payment) to be sent within 14 days deadline as from the date of the request, or I will not hesitate to take further action, so I would appreciate it if you could make the payment promptly or by the 14 days as requested to avoid further action on this matter.

This tends to work for most people, and no court action is required, but this does make them think, they know they have to pay out, so it will be worthwhile writing, if they do not get back with then money within 14 days of when you write the letter, then I will try to get hold of that person who helped me, he is not available right now, but should be by then.;)

    Hope that is okay annodam.;)

    Cheers Pinknico hunni.:A

I think there is a chance they will respond but don't be surprised if they do not. I carried on writing to Firstplus after their final and they ignored the letters...

As the debt is still live then you can request an executed agreement for £1 too.:D

You request this under section 77/78 of the CCA and they have 12 days to comply.

I thought I was really bright thinking about proving the different coloured tick on the original agreement.

I couldn't have got this far and felt so confident without you folks honestly, I really mean that, just want to say a really big thank you. You really do help little people like me fight the big people.

Its is sad for anyone that got sold something from any company not regulated. All sales of insurance became regulated as of 14th Jan 2005 and before that if they were GISC members of a Bank etc...

So there is nothing else I can do about this then?

    Hi Mike

I am not sure where you would stand with the FLA, Financial leasing association, check them out here and ring them as well if you want to, they may be able to help or lead you to the right direction, although I cannot promise anything here hun, the only other option you may have is court, where I am sure someone will be able to help guide you with this if you decide to want to go that direction.
Here is the link here for FLA
    http://www.fla.org.uk/fla/

Good luck Mike and please feel free to post anytime.
And if you do contact the FLA, if you could let us know what they say, that would be good, also to help others in the same situation with this company.;)

Thanks everyone, when i rang last week they said they had 28 days to get the cheque to me and i was told the 28 days would be up on 14th January, i was told earlier today that i would get the cheque 'very soon', but as of today it hadnt been posted out, i will give them until friday and if nothing then i will try the 14 day letter as my frequent telephone calls dont seem to be working! Its so frustrating, knowing the money is coming but not knowing when anymore! id appreciate any help with the letter phrasing if you dont mind! sorri to be a pain.

    Hi Pip

I am not the one for maths or calculations, here but I am sure Marshallka, or someone will be able to help if you want something worked out for you.

However, if you have settled a loan and was mis sold, they should put this right as if you did not have the PPI from the start of the loan, plus contractual interest and 8% of what a court would award.

If the loan is still active, they may offer to reduce the loan and have less repayment to pay back.

For instance, my loan was settled, the loan PPI alone was that of over £10K, they repaid me back for the amount of just under £13K, that is with the interest, hope this helps.;)

    Hi annodam

I expect you have read my post left above for you regarding this.

I would just keep it simple, as I believe this should still nudge them.

    Dear Sir/madam

I am writing to you regarding my refund which is due to me, this is about the Payment Protection Insurance (PPI) where you confirmed it would be with me very soon when we (spoke on XX/XX/XXXX on the telephone) or
as stated on your letter dated XX/XX/XXX) if by letter.

I feel you have had ample time to pay me this cheque owed to me, and now I am requesting you send this to me within 14 days of date on my letter, or I will be forced to take further action.

To avoid further action being taken, I expect to receive the cheque payment within 14 days and would appreciate it if you send this by recorded or special delivery in order for it to reach me safely and for me to sign this item, thank you.

    Yours sincerely

    ...................................................................................................
Hope this helps, its just a simple letter, and change to your own words if you want to.;)
