    got an email back from FOS regarding my two complaints about Ocean Finance.
    It says they will be dealing with both complaints under one ref number, so hopefully they will both be seen by an adjudicator at the same time and resolved at the same time.

    Hi Marshallka & Di,
    Happy New Year !
    We have just returned from a months holiday and had still not had the SAR back from nemo.We chased it up as it was a month over the 40 days and it arrived on saturday.There is no recording of the phone calls, just loads of paperwork !! We wanted the recording mostly as there doesn't seem to be anything relevant to our claim in the paperwork!
    What is our next step? Should we just go for it and send the template letter?

    Hi there

    Who did you get your SAR from?

    I requested mine from EGG and MBNA and both failed to give me the telephone calls, its seems these companies are all failing to give the evidence they know will see them in the wrong.

    You can make a complaint the the ICO (Information Commission) they have an online complaints form you can complete. You can also upload supporting documents. I would definately make a complaint.

    I would also make sure you have all the evidence you need before putting the first template letter in

    Hi Katz, Happy New year to you too...;)

    I would write back and ask them for the recordings. Sometimes they leave them out and hope you will not ask but if you write back and mention the ICO they may respond with these.

    Perhaps hang on a little until these arrive. You need not give them another 40 days as they should have sent these from the last letter. Then you may have evidence in these to back up your letter. If they do not respond with them then contact the ICO saying you believe they are with holding them. Its up to you wether to go ahead with the template now but I would hang on a week or so...;)

    Great news... have they said an adjudicator will on the case soon??

    Thanks for the reply.
    The SAR came from Nemo Finance. It makes me so angry that you have to pay for these and they are sent out to you way past the cut-off date and then the information you need the most hasn't been sent!

    Let's hope your right there Marshallka. Although Mr Rixom told me this morning that they have not received any letter from the ombudsman, I enclosed a copy of the letter I received when I sent in my second letter. He said he had received it on Friday. He seemed to be stumbling for words this morning and said it was because he had just got in.
