Yes maybe.....:D , and maybe that is why they have not provided it already, I don't know.

Hi, Ive not been on here for a while but currently investigating the PPI reclaiming. without having to read through all the pages on this thread already and i apologise if this has been discussed before.
Before i go ahead and attempt to reclaim the PPI on a loan with Natwest, what is the story if you have had proceedings issued against you for the loan for which you are reclaiming? I have a CCJ for this loan which was taken out around 5 years ago. i cant believe that i actually have the full paperwork for the two loans taken out with Natwest. they would not almalgamate the second loan with the first so i had two loans running consecutively both with PPI.
Any info much appreciated.

I do not know about dealing CCJ's myself, not yet anyway lol, but I know receiving some money back would be a help to you in this situation.
I do hope you are in the position to reclaim here, the way I see it if you were mis sold, its your money and you should get it all back, however see what someone else on here has to say about this and if you can go ahead with this by all means we can help guide you here.
It makes me think though that we would not be in such a position if we were not mis sold these expensive policies which does not help situations.

Sorry I've been catching up on the posts, omg yous have been busy bees.
It says if you are not happy with the cover then simply return this doc to us within 30days of receipt and we will cancel all cover without charge.
It also says: If you settle your loan or cancel your policy before the end of the insured term you will receive a partial refund of your premium. This wil not be proportional and will be substantially less than the amount you originally paid. No refund will be payable however if you have made a successful claim under the policy T & Cs prior to cancelling your policy or settling your loan.
It appears also that FP and the insurers have the Master Policy?:wave:0 -
Just had a thought when I read that there:
One minute its telling you, you can cancel without charge 30 days then the next it says if you settle your loan OR PPI before the end of the term you will receive a partial refund?

When did you have this loan hun was it after 2005, I think if it was after Jan 05 and it was a phone sale then they should have recordings of this, if not I would question them on this and tell them if they do not supply the disc you will contact the ICO, this may make them cough it up.;)The one and only "Dizzy Di"0 -

I think but am not too sure, but the claim would not be about the CCJ or any proceedings that have been, it would be about the mis-selling of the PPI, if you can prove it was mis-sold then I would go for it.
You could also call the CAB who will probably be able to confirm this.

Is PPI - Payment Protection Insurance A Scam
Payment protection insurance (PPI) has been given a hefty battering of late. PPI is an insurance designed to protect the continued repayment on borrowings if you the borrower find that through accident sickness or unemployment that you are unable to meet your commitments. PPI has had a real scrutinisation by the FSA (Financial Services Authority), been criticised by the consumer magazine Which? and is now under severe investigation by the Office of Fair Trading. These organisations are primarily concerned with protecting the rights of you the consumer. So then what are they so uptight about:-
The major concern centres around information given at point of sale i.e. whether you are given sufficient information at point of sale to make an informed decision about whether to have PPI or indeed whether you need it. There is a massive variation in the retail cost of PPI policies which also raises concern as do the huge profits made by lenders marketing PPI as there are only a few claims made by borrowers and even less paid out their is also concern regarding how few PPI insurers are not linked either to the banks or lenders directly
The 13 main areas of mis selling:-You were told that you had to take the PPI out at the same time as the loan or not at all.
You were told that if you did not take the PPI you could be refused the loan or card.
You were either unemployed or self employed at the time.
You were not asked if you had other insurance to cover the loan.
You fell outside the age restrictions of the policy.
You were told or led to believe that PPI cover was compulsory.
You were pressured into taking PPI.
You were not made aware of policy exclusions which may affect you or your ability to claim.
you increased your loan and the PPI cover was automatically increased.
The small print i.e. terms and conditions were not adequately explained to you.
You paid up front settled early and did not receive a refund.
You paid an up front single premium and it was not explained to you that there was a monthly alternative.
You were not told that you could get PPI elsewhere to cover the loan.
If your loan, HP, credit card, store card, or mortgage company has fallen short in just one of the 13 areas above whilst selling you a PPI policy you will be entitled to your money back plus interest.:wave:0
