hi hope someone can advise, I sent my complaint to black horse 1 year ago now and they replied - quickly saying tha they felt they were in the right and that I was not 'misold' my policy as I had stated. I then contacted the Financial ombudsman who have have my complaint since the 4th of January now. They initially kept in contact every 2-3 weeks but I have not now had any correspondence from them since March. I did not feel that this would be a really complicated case and understand they may have now been inundated with similar cases. Surely the ombudsman also have some kind of turnaround/code of conduct? I feel like I have not got very far with this and it is going on a year now since I first started the wheels in motion. Does anyone have any comments? please Dawn

    Hiya Dawn

Wow you have been waiting for some time on this.

I would give them a ring to find out there they are currently with your complaint, tell them its been quite a while that you have not heard a thing.

If it was complexed then I would understand and yet if its being passed on from the adjudicator to the ombudsman himself they do tend to let you know.

Give them a ring just to see where they are with this, it may give them a bit of a nudge.;)

Please let us know, cheers and good luck.....:D

I felt the same way as the fos had my initial complaint in december last year. They finally upheld my complaint 4 weeks ago so hopefully not too much longer!

We have been paying them for years under a DMP but recently decidie enough was enough & try to bite bacxk at the hard faced DCA companies that have hounded us over the years.

The account we have is not statuet barred as they have had regular contact & some minimal payments from us over the years.

When we recently requested a copy of our original consumer credit agreement they sent us a statement showing the original loan wiyth PPI added since 1999 but no CCA .

So basically without this CCA they cannot enforce the Debt any Longer but if we get to that statge where they agree to right off the debt because They have to by law wjhat chance have we got of getting the £2491.63 ppi insdurance payment refunded?

Am I being too cheeky here if they right off the Debt should I just go away?

    Many thanks,

    Simon
If they write off the debt then the PPI will be part of the debt:confused: .

No front loaded means it was added to the loan so it becomes part of your loan. So you cannot cancel PPI unless you re finance Loan. If you have stand alone PPI it is like on a credit card where you pay monthly and if you want to cancel they will just cancel the agreement

In that case yes it was front loaded - what are the implications of that??:money:

A front loaded policy is a loan to pay the PPI on top of your original loan. Therefore it not only costs you the amount they say on the agreement but also interest is chargable on this for the full term of the loan... .

Hi Dawn, we too have 2 complaints with FOS one for egg and one for mbna, like you they kept in regular contact, with mbna they found in our favour but mbna wanted a higher adjudicator to re look at it, delay tactics l feel! Egg we've heard nothing for ages although both complaints were put in in feb this year, lm afraid its just a waiting game, these companies know they're in the wrong and they'll do anything to drag their heels. The FOS said they've been snowed under with complaints, (not bloody surprised!) maybe OH could get a job with them ,as building work is pretty scarce right now.
