    Hopefully they will find them and send to you very soon, where then you can try to pursue them for the ppi.;)

    Have you any old bank statements from years ago which may be a help?

    We have been paying them for years under a DMP but recently decidie enough was enough & try to bite bacxk at the hard faced DCA companies that have hounded us over the years.

    The account we have is not statuet barred as they have had regular contact & some minimal payments from us over the years.

    When we recently requested a copy of our original consumer credit agreement they sent us a statement showing the original loan wiyth PPI added since 1999 but no CCA .

    So basically without this CCA they cannot enforce the Debt any Longer but if we get to that statge where they agree to right off the debt because They have to by law wjhat chance have we got of getting the £2491.63 ppi insdurance payment refunded?

    Am I being too cheeky here if they right off the Debt should I just go away?

    Good to see your fighting your ground here hunni and keep at them.

    You can still try to reclaim on this, its not your fault if they are unable to supply the CCA.
    I think there may still be a chance here with the PPI.
    The way I see if if you don't ask you don't get, so give it your best shot.

    I can actually agree with the ppi side of it but do not know how it actually works on the whole debt, maybe someone else could have an answer here for you, but if you don't try you will never know.

    Have you attempted reclaiming the ppi yet?

  • Hello folks. I hope someone could give me a bit of help here.

    I basically defaulted on a 3k loan a good few years back and only just started dealing with things and getting back on track. The debt was passed onto Teressa who somehow got my number and called me out of the blue. I put my hands up as it was mine and I'm currently payment a small amount each month but this will take years to payback. I only work past time and am a student so cannot afford too much right now. Anyway, after reading posts on here, i asked for proof that they were now in charge of the loan to be sent to me (Mainly becuase of the attitude they have) which they did. However, upon looking through the original company statements they sent, i noticed i was paying for payment protection throughout the initial period of the loan. I did not ask for this and i've even got a copy of the original signed loan form from Teressa which DOES NOT have a tick in the box to take this cover.

    As this has now been passed onto Teressa, can i argue a case against them and get the amount deducted from what i owe? It would amount to approximately £600 until i defaulted on the loan which is a sizeable chunk of the outstanding amount. The bottom line though is that surely that must be somehow illegal to charge me for the PPI when i have the document showing i did not request it.

From the date Tessera obtained this to the day they contacted me, they added interest every single day which amounted to about £1200, more than a third of the loan.

    Are they allowed to do that even though they never contacted me? I'm sorry if it appears i'm trying to get out of things. I know i've done wrong and i'm genuinely dealing with things now (And feel a million time shappier for it) It just annoys me a bit that this heartless company is getting the money. I'd much rather be paying it back to the original lender.

    Hi there Jason

    I did also leave you a message on your other thread to post here, glad your here.

    Now we will work on the PPI here as I believe charges may come under another complaint, although this can be confirmed by someone else.

    I would write to them to reclaim on this on the grounds of being mis sold this due to your circumstances at the time, they should have checked with you first to make sure you were eligible.

    They may get back to you with a first letter with a fob off standard template they use for most customers that they supplied you with a booklet etc and that you could have cancelled, but hun many of us have been in that situation, so another letter will be needed in order for them to reconsider until you receive the final resonse and will do no more, where then you should be able to take it to the FOS to complain.

    There is also a template to help you with your letter, they have 8 weeks to respond, post by recorded post.

    Sorry if I have not answered fully to all on your questions but if you feel you were mis sold where in my opinion you do have good grounds, then go for it and good luck.

    To me, the issue seems not to be that i was mis-sold it, it was that i never asked for it and the form actually had a box to tick if you wish to take out the policy. I did not tick that box and have the photocopy to prove it so isn't that even worse?

    I'm would like to add that i'm a bit concerned about 'rocking the boat' as it were, so would like to think i have a good case before writing. The really don't want them to suddenly turn on me and demand more payments because i'm answering back, etc. The debt is still there, but i'm currently enjoying sleepful nights for the first time in a while and wish for that to continue.

    Yes your right, so whoever sold you the credit is the ones to write to.

    You do have a case here if you have your own copy to prove that you did not tick the agreement.;)

    May I just say is to wait to see what others have to say about this here, but I do know on the ppi side of it your case looks promising.

    Would be good to get rid of the debts I know.;)
    But as I said see what others have to say here who maybe able to give further info.

  • hi hope someone can advise, I sent my complaint to black horse 1 year ago now and they replied - quickly saying tha they felt they were in the right and that I was not 'misold' my policy as I had stated. I then contacted the Financial ombudsman who have have my complaint since the 4th of January now. They initially kept in contact every 2-3 weeks but I have not now had any correspondence from them since March. I did not feel that this would be a really complicated case and understand they may have now been inundated with similar cases. Surely the ombudsman also have some kind of turnaround/code of conduct? I feel like I have not got very far with this and it is going on a year now since I first started the wheels in motion. Does anyone have any comments? please Dawn
