    Mine said about the use of rule 78 in the rebate... also no cancellation at all on mine and should have been...:confused:

    Get one, you are entitled within the SAR request...its a tape recording not a disc but you can request a disc at extra I think!!!

    Thanks for that, but would it be a tad fruitless now to write to the original lender bearing in mind they passed the debt on a few years back, or are they still liable?

    They are still liable for the misselling. You cannot claim against anyone other than the firm that actually sold you the policy in the first place.

    I am looking into reclaiming credit card protection from Egg, I have my statements showing how much I have been paying for last 6 years is that enough or do I need to ask for credit agreement?

    You can still try to reclaim on this, its not your fault if they are unable to supply the CCA.
    I think there may still be a chance here with the PPI.
    The way I see if if you don't ask you don't get, so give it your best shot.

    I can actually agree with the ppi side of it but do not know how it actually works on the whole debt, maybe someone else could have an answer here for you, but if you don't try you will never know.

    Have you attempted reclaiming the ppi yet?

    Also when was this actually applied to your card in the first instance?

    Is PPI - Payment Protection Insurance A Scam

    Payment protection insurance (PPI) has been given a hefty battering of late. PPI is an insurance designed to protect the continued repayment on borrowings if you the borrower find that through accident sickness or unemployment that you are unable to meet your commitments. PPI has had a real scrutinisation by the FSA (Financial Services Authority), been criticised by the consumer magazine Which? and is now under severe investigation by the Office of Fair Trading. These organisations are primarily concerned with protecting the rights of you the consumer. So then what are they so uptight about:-
    The major concern centres around information given at point of sale i.e. whether you are given sufficient information at point of sale to make an informed decision about whether to have PPI or indeed whether you need it. There is a massive variation in the retail cost of PPI policies which also raises concern as do the huge profits made by lenders marketing PPI as there are only a few claims made by borrowers and even less paid out their is also concern regarding how few PPI insurers are not linked either to the banks or lenders directly


    The 13 main areas of mis selling:-
    Check-red.gifYou were told that you had to take the PPI out at the same time as the loan or not at all.Check-red.gifYou were told that if you did not take the PPI you could be refused the loan or card.Check-red.gifYou were either unemployed or self employed at the time.Check-red.gifYou were not asked if you had other insurance to cover the loan.Check-red.gifYou fell outside the age restrictions of the policy.Check-red.gifYou were told or led to believe that PPI cover was compulsory.Check-red.gifYou were pressured into taking PPI.Check-red.gifYou were not made aware of policy exclusions which may affect you or your ability to claim.Check-red.gifyou increased your loan and the PPI cover was automatically increased.Check-red.gifThe small print i.e. terms and conditions were not adequately explained to you.Check-red.gifYou paid up front settled early and did not receive a refund.Check-red.gifYou paid an up front single premium and it was not explained to you that there was a monthly alternative.Check-red.gifYou were not told that you could get PPI elsewhere to cover the loan.


    If your loan, HP, credit card, store card, or mortgage company has fallen short in just one of the 13 areas above whilst selling you a PPI policy you will be entitled to your money back plus interest.
