Take them to court, simple.
A contract consists of (simply) offer, consideration and accepetance.
This is deemed a contract
£750 = offer and consideration, you accepting this offer makes it legally binding.
Full stop.
If court terrifies you call the FOS!DS1 12/10/04

Sorry but why does the fact you have a capital and interest loan affect the offer and what are they recalculating such loans for?
I have no idea! This is the thing, I was upfront and honest with all details during the investigation forms I provided. They considered it, made me an offer and now have retracted it three weeks later saying pretty much " It's a capital and interest loan - the letter shouldn't have been sent "
The settlement letter, which eventually made me the offer, was FIVE PAGES LONG. Sent in ERROR???0 -
I am in process of trying to claim PPI back from 3 companies all currently waiting for FOS to deal with but then today had a letter from FOS saying that one company London Scottish have gone into recievaship. They have said they are not sure how this will affect my claim but will let me know in the next 4 weeks... I just wondered if anyone had ever been in the same possition and if they could tell me what happened to there claim?
any info would be greatly appreciated
Thanks Jules:rolleyes:  :rolleyes:I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.

I would not worry about it and just take it up with them, ask for their legal point of view, listen to them squirm!0

Thats how I'm leaning. The letter they sent today "...unreservedly apologizes that the offer was made " and the it is an error on part of RBS. The fact that they said they " have no time scale on recalculation " (and as someone pointed out, why this affects the claim anyway) makes it worse0 -

My loan was taken out with them in 2006 but PPI misold claim was place in July and is now with FOS:rolleyes:I have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.

I fully intend to. Usually I'm the most patient guy but I was truly shocked today. Even if they had turned round in November and rejected my claim having considered all the evidence I could have understood to consider my options, but the fact they said "Yes, we agree to a settlement" and then turn round three weeks later (having already waited eight weeks for a reply) to say "Whoops, we shouldn't have sent that - we don't know when (or if) we will make you another offer" has made me very annoyed.
I'm going to call RBS and demand a full explanation tomorrow, but would people say the FOS is the best way to go?0
