    Their letter was dated 21st October! Haven't heard a bean from them since. nor I have been in contact with them.

    I calculated the 16th (today) as being 8 weeks from the day I sent the first letter.
    I take it yours is worse than mine then if you are male...:rotfl: .

    Thank you all for your help and i'm afraid i agree with you all, yes its sad ppl are losing jobs because of the current climate but why should we be unfairly charged/not rebated so the banks can keep a bigger profit? We work to keep a roof over our own families heads not the bank managers :rolleyes: And with an 8wk old little girl and poor maternity pay i think i would rather the money was in my bank :D

I do not remember taking the Capital One PPI and the Adams Card i got from applying in store and do not remember being asked if i want protection. It was in the 6 month statement i see now they have started charging me. Also i see Capital One are being fined.

    Thanks for the resposne and thoughts, they are appreciated.

    Just want to show that its not the fat bankers that get hit in these situations, its the people at the bottom of the line, normal working class, jsut trying to make ends meet working.

    Lots of jobs could be deemed immoral, however people do them.

    My point was that there is not always a valid claim, some times consenting adults agree to these policies and then when they dont feel like paying anymore or need some cash out comes the "where there is a blame there is a claim" mentality.

    This is what i was trying to relay before the forum police jumped on me.

    In response to how i can help asked by another member, use your noggin, i worked in the industry for 4 years, i am aware of the small prints, compliance and legal issues, where companies went wrong, sales lines that had to be ammended as they were misleading.

    So i think i CAN help, so please dont assume i am on the side of the banks because that is not the case.

    If any of them occur to you then you have a case, there is also a template letter on the above link, but add your own reasons and as much info in your own words as much as you can.

    They have 8 weeks to respond in full, if not successful and this has not gone in your favour, you may be given the opportunity to write to them further with further information, or they will disclose on the letter with an enclosed leaflet that you can now take your complaint to the Financial Ombudsman in order for them to investigate.;)

    As always post by recorded delivery for your proof, and let us know what they say hun.

    The cooling off period was 14 days I thought it was 30 days, when I tried to cancel after about 25 days I was told I could cancel but I would still have to pay for the PPI as the cooling off period had past, so I didnt cancel it.

    The PPI was to cover the car finance if it was written off before the finance was completed, I understood this but once I read a bit about PPI I wanted to cancel but I was past the cooling off period and when they said I'd still have to pay for it I thought I may as well keep it :mad:

    In this instance would the PPI not pay out for the same reasons as detailed in the template letter such as self employed or medical reasons?
  • Howdy all I'm not sure how much detail I'll need to provide, but I'm hoping someone on here can give me a clue of how to proceed with my PPI reclaim as it's taken quite a nasty turn... Basically I have a Graudate loan with Natwest from 2005, with PPI that I thought was quite manhandled onto me so after reading through the site I copied the template letters from this great site in September '08 and applied the bits relevant to my circumstances in an attempt to get it back.

    RBS replied fairly promptly at the start of the October saying it would reply in due course in the usual eight weeks. Eight weeks passed and on the deadline (round about the 18th November) they sent a letter back saying, whilst they thought all my points were rubbish (I'm paraphrasing, ha!) at the end they said they would be willing to make a settlement offer of £750 if I concluded the matter. I considered it and decided to accept.

    I posted a reply back on Nov 21st signing the consent form and waited... Until today. December 16th I receive a letter from RBS saying " You have a capital and interest loan - the settlement offer you received was sent in error and we retract it. We unreseverdly apologize. We are in the process of recalculating such loans but unfortunately we do not have a time scale on this "

    So I'm back to square one. I'm angry that three months have been a waste. I fully intend to pursue this tomorrow with the rep from RBS but please, if anyone knows how to proceed from here I'd love to hear from them

    Take them to court, simple.

    A contract consists of (simply) offer, consideration and accepetance.
    This is deemed a contract
    £750 = offer and consideration, you accepting this offer makes it legally binding.
    Full stop.

    Sorry but why does the fact you have a capital and interest loan affect the offer and what are they recalculating such loans for?:confused:
