  • Recently had a letter back from FOS stating that their next step is to pass my papers onto an Adjudicator - How long does this part of the complaint process normally take?

    You can never tell. Mine was passed to an adjudicator in April they paid out in July but am still arguing.

    They usually send off for full SAR which can take 40 days and then make their decision on that info plus the info you sent in. They when decision is made they have six weeks to settle but they can then extend that if they are busy:eek:

    Hope that gives some idea. I would think probably by Feb. :D

    The letter is going off to them today - I thought it well worth taking an hour out my day to draft it!

    I'm not on benefits at the moment, but a lot of my stressing and anxieties over money started when I was on benefits a few years back and I thought I was going to lose my home, couldn't get a job for love nor money and I thought I was losing everything I'd ever worked for. Although I'm in a good, well-paid job at the moment, I still don't sleep whenever I have to worry about money. (The unemployed period is where the council completely messed up my CTB claim - I only know about the arrears because I challenged the banding and it came up in correspondence, "Oh do you know you've underpaid from 5 years back?")

    I've said in my letter to the FOS that I've had to be put back on prescription medication to control the anxiety, and also provided them with details of the arrears I have at the moment showing them the monthly payments I'm making at the moment.

    Hopefully they take pity on me and just make a bloody decision - whether I'm successful or not, I'll least I'll know where I stand. It's like waiting for exam results; at first you want to pass, and then after you've waited for a result, you just want to know what it is, pass or not!

    Will you let us know how you get on with your fast track. I would like to fast track mine but I am not on benefits either. It's not fair really, I have a huge mortgage, am a single parent having to pay a childminder, just had to take another secured loan as have been living off credit cards and after paying bills have no money left to feed us! I sometimes think I would be better off on benefits.

    I appreciate what you are saying and it must be difficul t for you. Loads of people have now tried to use that line and I think what was fast track is now slow track. Have you tried yet. Let them know your circumstances, you will have to show evidence e.g. Bank statements benefits etc etc. I wonder whether it may be better to put that down in a letter by registered post cause I am wondering whether all us people that send e mails are not getting the same service cause a quick delete button gets rid of the complaint whilst when it is with a letter it is a formal document.

    Just a thought anyway. But good luck:D

    I hope it all goes well for you. They take ages and the lenders are not being helpful cause they are so busy:eek: hmm wonder why. I hope you get a response soon and then usually they pay out in six weeks. :confused:

    No I haven't tried. I probably will just sit and wait my turn. Got a letter a couple of months ago asking if my circumstances have changed and if I was on benefit blah blah. I could give them evidence of how broke I am (not trying to plead poverty here). It just grieves me sometimes that just cos I have a reasonably well paid job I must be well off! No one ever takes into account how much you have to pay out, they are not interested.

    I note what you say about emails, they can delete them of course, but you do have evidence that they received it. If you don't get a non-delivery email back, it means they received it.

    Yes but my point is just that you have that back they have no proof of what has gone through. Even if you have a no delivery it does not mean that they can confirm they have received it. Try fast track it should not be just for people on benefits. People that work can be having problems the same as those on benefits. A letter is a legal document whereas I do not think an e mail is.

    Have a think anyway and I hope they do not keep you waiting around too long:D

    This was what I have said on here so many times. Its seems if you work for a living and pay your mortgage and council tax (although we pay interest only at the moment as we could not afford otherwise!!:rolleyes: ) you are treated as the "rich" and then someone who is having the mortgage paid and on benefits so no council tax to pay (which if not paid by the working man can mean an offence:eek: ) is treated as poor. I put on here a few months ago that after paying out our mortgage, council tax, etc we are worse off than some on benefits...:mad: . The system makes me sooo annoyed..

    If you do try Anne.Jade then you may get the same reply that I got for my Firstplus one (although it seems FOS is having problems with Firstplus at the moment as catinthehat posted yesterday that their were Regulatory matters involved with hers and other firstplus complaints!!!) in that they will say "we have noted it on your file".
