Hi Nutmeg

Personally I would keep all communication in writing. If you ring be very careful with what you are saying because they will probably record the conversation. This may then be used against you later. Personally I would write back to them and say you would like all communication by letter. If you do this and then have to take it to the FOS you will have evidence that you can send to them.

Good Luck:D
thanks for help maxdp, will e-mail them now and ask for all correspondence

• Hi guys!!

Update and advice needed please :-( Got my letter from GE money reagrding my second account. In the letter they advised me that my Miss Selfridge card was originally taken out with Duet so they could not investigate miss-selling as they did not sell me the policy. Fair enough I thought but syrely they checked my credit agreement from Duet when they took over the account to ensure I was eligible for the GE money account cover so I called them. The lady on the phone said that when they recieved the credit agreement from Duet they wouldnt have checked and would just have added the cover - I am astonished that they wouldnt check!!! I then said to her well surely you have a copy of my credit agreement with Duet so can you send me a copy please so I can check what I ticked for employment to wich she told me that they may not have ever recieved it!!! What shall I do now? I have written a letter (well half written one) and said that I will write to Duet regarding miss-selling of policy but how on earth can GE money then automatically add account cover to my account with them when they took it over without checking my agreement (if they ever even recieved one!). Surely if they cannot provide evidence of me needing the cover and I send them deatils to back up my claims I was a student I would be entitle to a refund?

Help please experts :-)

Hiya hun
Thanks for letting us know on your update.

Seems like they are giving you the runaround here.

Now its whoever sold and arranged this for you is responsible and you may require a SAR which is a Subject Access Request, if you want the template for this let us know, however this will cost £10 cheque or postal order payment and they have 40 days to comply.
They must supply EVERYTHING they have on you including emails and phone calls if any.

Post by recorded delivery hun this is your proof of them receiving this request and you can then keep an eye on the 40 days they have.

Or if you want to just be certain on this wait to see what Marshallka or what anyone else thinks is best here.;)

Good luck and let us know if you want more info and the SAR template.
Cheers

• Thanks Di :-) I just really want to know how they can add this to my account if they never checked my credit agreement. I have written to Duet about miss-selling but obviously GE money must have had to review my agreement to add the policy?

• my bloods boiling so have written a bit of rant in the letter - how does it look?

Dear Sir / Madam
Miss Selfridge Account Number:
Ref

Thankyou for your response dated 27 November 2008 which I received today. As you mentioned in your letter I have now written to the original company who sold me the policy and await their response.

]After receiving your letter I telephoned your offices on 28th November 2008 and spoke with a representative. I enquired if it would be beneficial for me to send you copies of my University transcript and also a letter from the institution to support my claims that I was in fact a fulltime student from the period of September 2002 until May 2006 inclusive. The lady advised me that as GE money did not sell me the policy that I would have to take the miss-selling up with the third party company which I have now done. I then asked your representative if they were able to provide me with a copy of my credit agreement for this account and was told that they may not have received this from Duet when it was taken over. I found this astonishing and asked how GE money could then automatically add their insurance onto my new account with them if they had never even seen my credit agreement and checked the details to ensure I would be eligible for this cover! They did not provide me with satisfactory information to make me think that I have been treated fairly and I would now like a full explanation of how account cover can be added if you have been negligent and failed to check my original agreement to ensure I was in fact in employment.

I am horrified that a company can simply add on insurance cover when they have not checked that an individual is in fact eligible for this and my evidence enclosed supports my claims that I was in fact a fulltime student with no means of income. You also mention that I would have received an update account policy in the mail when this account cover5 was upgraded with GE money but this was in fact never received by myself.

As this account cover is still active on my account I request that you cancel this with immediate effect and that you confirm this in writing to me as soon as possible.

Unless you can satisfactorily justify to me that the policy which you added to my account when GE Money took over was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid during my period in fulltime employment. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made.

I look forward to a full and prompt response to this letter and for the matter to be concluded within seven weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.

Yours Faithfully

I take it this was over the phone this was all said?
Yes I know what you mean, and I would think they should have had to review your agreement to add the policy.
They may be fobbing you off hun, but if you write which is the best method for evidence wise (recorded delivery post) they MUST get back to you within a reasonable amount of time with an explanation of this, phone calls like Marshallka says can be unanswered where they tend to fob off.

See what Marshallka says about this hunni, she may have best ideas here for you.;)
I'm sure it will all work out in the end and I find this quite baffling myself to be honest, something is not right.
