    Hi Nutmeg

    Personally I would keep all communication in writing. If you ring be very careful with what you are saying because they will probably record the conversation. This may then be used against you later. Personally I would write back to them and say you would like all communication by letter. If you do this and then have to take it to the FOS you will have evidence that you can send to them.

    Thanks very much for the information back Marshallka. Your assumption is right. I'm not sure what you mean by class 2 NI. My pay is done in such a way that I don't earn enough to pay NI because most of my money is paid as a dividend

    Hi Celtic charmer is that cause you are paid on commission basis only or do you have small basic then made up with commission. Or have I completely got hold of the wrong end of the stick:confused:

    Morning everyone,
    Received a letter from HBOS upholding my claim for PPI on my Halifax credit dard wes in fact mis-sold, due to the cover I have through my work benefits, my claim is for £728.00 which includes the statutory interset. Just waiting for them to send the cheque, and I will post the full amount and also put it on the reclaiming success board, special thanks to di3004 & marshallka, for proof reading my letters and the great advice. I couldn't have done it without your help. Just waiting for Capital1 to give in now.

    Hi there
    I am seeking advice on whether you only get 8% interest for compensation on a PPI claim
    Last August I received letter from FOS stating that HBOS would refund all premiums plus interest, additionally it will pay credit interest at 8% simple

    Today I received calculations as follows:
    Refund of Premiums = £1399.82
    Interest for compensation at 8% = £370.91
    Total = £1770.73

    I contacted HBOS today and asked regarding this credit interest of 8% and they stated that it does not apply on secured loans, but I am going to phone FOS on Monday to confirm this

    I have never heard of this before!!!:confused:

    Surely you were deprived of the money and that is it... I would ring them on monday and find out what they are playing at here.

    As maxdp say here. Reply by letter only. They could twist anything you say to their advantage. I would not trust them to not do this.

    ALso send your letter recorded too.

    Do you not pay an sort of NI then... if not then I doubt you would be covered here. I would just try and make a complaint/claim and see what happens.

    Just take a look at the link here and see what you can add and delete from the letter that you send. There is also a template letter on there too but sometimes it can be better to make your own up from this.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    Hi folks

    Will catch up on your posts above, a letter arrived this morning, even though its from HFC again its Endeavours logo paperwork, but its the correct department as addressed by the FOS when they sent the details, I am gonna write the letter in another post in a min, not good news I'm afraid.:confused:

    Thank you for your email to Mr J S dated 26 November 2008.
    I am sorry to learn of your continued dissatisfaction. In accordance with the bank's complaints policy, your details have been forwarded to me for my independent review.

    I would like to confirm that the rebate you were given for your insurance upon settlement of you loan was £1,533.69. This was calculated using an industry standard method in banking known as the "Rule of 78". I have enclosed a document explaining how the Rule of 78 is calculated, which was also included in your borrowers guide leaflet presented to you upon completion of your loan with Endeavour Personal Finance
    (EPF).

    Following a further review of the points raised, I must inform you that EPF's position regarding your complaint remains as stated in previous correspondence issued to you on 12 August 2008 and therefore I have nothing further to add to this matter.

    I must advise that you have now exhausted EPF's internal complaint procedure and no further correspondence will be entered into regarding this matter.
    Any correspondence received from you concerning this matter will be read and filed but not responded to.

    Your comments regarding the Financial Ombudsman Service have been noted: however EPF did not fall under the jurisdiction of the Financial Ombudsman Service prior to 6 April 2007.
    As your complaint relates to an issue that occured prior to this date, we believe they may not be able to adjudicate on this matter.
    It is important to clarify that whilst HFC Bank owns EPF, the products offered under each brand are different and as such, are subject to differing arbitation services.

    Regarding my letter above received today I thought I would sent an email to the FOS consultant in readiness for next week, typical to get an immediate response on a Saturday of an out of office reply here, so it now looks we have to wait flipping longer !!!
    Normally we do not even get a reply at all !!:mad:
