    I am not sure if I can reclaim PPI for a Loan that went to Blair Oliver & Scott in 2006 as I was unable to repay the monthly instalments.

    The PPI (ASU cover) was arranged by Pinnacle Insurance, the loan is from Intelligence Finance.

    I don't have the original papers but just the Policy Number. In 2006 I contacted a Debt Management Company and they arranged with BOS for an arranged payment. At that time, in June 06, they suggested me I stopped paying insurance on the Loan because it was not necessary any longer, given the fact that the account was in the hands of BOS.

    My Loan and subsequent ASU cover (PPI) was arranged by an Independent Financial Mortgage Broker that was a con man. He had arranged for me insurance on every loan I had and every mortgage I had, with the following companies: Pinnacle Insurance (for IF loan), Optima Financial, Scottish Provider, Friends Provident. I don't even have any original paperwork for any of these, only for the Pinnacle Insurance one.

    My question is: can I claim PPI if the policy was arranged by someone else? I was really conned into it. I read your First Stage standand letter but it seems nothing applied to me.

    What to do? Any suggestions welcome. Thanks

  • I bought two sofas from DFS in October 2004 & took out PPI.

    I wrote to them last Saturday to say I had been mis sold the PPI as I had an existing medical condition & also already had insurance through my job.

    Got a phone call today from DFS head office today stating that no way had the PPI been mis sold.

    Has anyone else had this reaction?

    What paperwork do you currently have? Is it a SAR request (all info)

    If you can prove it was mis-sold then still put in your complaint to the broker or the bank.

    Who did you get your loan through?

    Hi there

    If you believe that you were mis-sold the ppi then you have to complain to the person or company that sold it. Any one can reclaim ppi if it has been mis-sold, you have to prove it has to the company involved.

    You can obtain all the information that is held about you by sending a SAR request and enclosing a fee of £10. You will receive all paperwork and telephone calls (if any made) they have 40 days to supply it all.

    SAR - SUBJECT ACCESS REQUEST

    Dear Sir/Madam

    Re: Account number:

    In the first part under the Data Protection Act 1998:

    Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, please supply me with a complete list of transactions and charges relating to the above accounts held with you since they were opened.

    Additionally where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my business with you.

    If you are unable to supply data relating to manual intervention because there has been no such manual intervention then please be kind as to confirm this in your response to this request.


    For the avoidance of any and all doubt, I reiterate:

    I hereby request that you supply me with any and all historical data in your possession which, in any way appertains to me, including (but not exhaustively) a copy of the original signed executed agreement; statements of account; duplicate statements and/or print outs of all account transactions; all internal and external correspondence sent or received by you including memo’s, logs, notes, screen prints and transcripts; notes of manual interventions such as telephone attendants' notes, copies of stored telephone conversations, internal and external emails; any other information held on any/all types of media in any relevant filing system (microfiche included).

    If you have disclosed any information to a third party (with or without my express permission), will you please include details of this in your reply, along with notes of any legal action passed or pending (to include a true copy of default notices, court orders and the like).

    Where any information that you provide includes any charges, for example returned payments, late payment fees, and so forth, would you please advise your breakdown of actual costs (liquidated damages) incurred for each charge, and the Term or Condition on which you rely upon to claim such a charge.

    I also require that you forward, within the above mentioned time scale, a true copy of the Terms and Conditions that were in force at the time my account was opened, and any subsequent amendments to those Terms and Conditions.

    I enclose the statutory maximum fee of £10.00 to access ALL data held by XXX about myself. You should be fully aware of your statutory obligations under the Data Protection Act and that any failure to comply with this request will involve a complaint to the ICO as well as potential legal action.

    You have 40 days in which to comply with this request.

    This communication has been sent Recorded Delivery so I can ensure compliance on these issues within the legislative timeframes.

    No I have the personal loan agreement, is it worth requesting all other documents now I have sent the letter?

    The loan was with the Halifax.

    Have'nt dealt with these yet but they are on my todo list.

    Did you know about the ppi or did the advisor tell you about it?

    Do you have any paperwork from them. I am presuming that the convo was in the shop itself?

    Yes its definately worth requesting all info, there may well be evidence within it to back your case up.

    Any evidence against them will make your case stronger.

    Don't matter that you have sent a letter to them already.

    Can I ask what are your reasons for it being mis-sold? There is a checklist on the homepage, click on the red tab then the checklist.

    I don't remember agreeing to the PPI, but at the time I had a crying baby who was screaming for his food, I only found the paperwork the other day when I was sorting stuff for shredding.

    I know that I wouldn't have needed this as I couldn't claim on the health side because of my existing conditions & already had cover through my job.
  • I was young and naive, they didn't even tell me that they had included insurance on the loan. I was in and out of the branch within about 10mins, how am I expected to prove that this is the case though, if all of the dealings were face to face ?

    I would send another letter stating what you have said about not agreeing to the ppi and the reasons why you would not have agreed to it (existing med conditions and cover already in place and ask them to prove it was not mis-sold.

    I have checked the fsa website and fisa and fla to see who regulated them but don't know who it was at that time.

    The others will b back on soon and may be able to advise on this.

    Send your letter recorded delivery so they can't deny receiving it. You could also call Consumer Direct who are pretty helpful they may be able to guide you further to.
