Right folks
I emailed the liquidators about the letter received today and here is his reply, although the FSCS know we have lodged the claim in with the liquidators...., so it doesn't look like they have been commuting with each other yet then.....:rolleyes:

You can contact the FSCS and advise them that you have now lodged your claim in the liquidation, it may enable them to move your case forward.

marsha, when cassidy davis took over they took over all the company or it would have gone bankrupt, so the fos to me are getting all the info & looking at the legal side to stop this company from riggling out of what it owe's. im reading it in a positive way. hope they get back to soon.0

guys can anyone offer any help??
complaint against m and s been with fos since sept 2007. allocated adjudicant in may 08.
my complaint has been upheld by the adjudicant 2x and they still are saying they will provide more evidence that it was not miss sold.How long do they need !!!
Looks like it may go to an ombudsman to look at. which may take another 6-8 months.
does anyone know how often the ombudsman actually overturns a adjudicants decision and if the timescales quoted are accurate..
i am getting deperate here guys as am in some financial difficulties too..(i know they can fast-track your case but need things like court dates/repossesion orders etcc...but not at this stage yet!)
Was soo needing some of the money for the kids at xmas..
ps ppi should be in region of 10K and i have no current relationship with m and s
help me please xxxx

I would contact them and tell them, they may move it on a bit quicker for you.
Explain your situation hunni they need to know this.

Laini who is on here got hers upheld in July and last month it was upheld again so maybe in time for christmas. Just keep on at them.0 -

I am a newbie here so i hope this question has not been asked already.
Myself and my husband have two car loans one with Welcome finance and one with British Credit Trust both are nearly at the end. Both of us are on the loans but my husband is the first one.
Two and a half years a go i was diagnosed with breast cancer and was not able to work for 2 years. Payments were hard to meet, when we enquired about the ppi we were told could not use it because i was not the first named on it this was not explained when taking out, and also we were told we had to have the ppi otherwise would not get loan, can u help explain, also has the loans are still active can we cancel the ppi on them now and reclaim anything back.
Any information would be gratefully recieved.0 -

Hi there and welcome, and so sorry to hear of the breast cancer, hope all is going well for you, both my younger sister and mum had this the same time but everything looking good now, hope the same for you too hunni.
If your hubby has not made a claim on this I would definately complain here about this, afterall your both on the loan agreement and the argument here that its not fair to cover the one and not the other, and its always the first one names - its so wrong, and I know the FOS would take a dim view on these policies.
Check this link out here I will add below, and whatever occurs to you plus your own reasons put into a letter, there is also a template letter on the link to help you.
They have 8 weeks to respond, post by recorded post.
Let us know the outcome in case further help is needed such as another letter or if it needs to be moved on to the financial ombudsman to investigate.

Hi,
I'm relatively new to the site and after checking through my paperwork I've realised that I was mis-sold insurance on a £8000 loan I took out in December 2002, the last payment was in April 2006.
Will the fact that it was so long ago affect my claim?
I've sent the 1st letter today by recorded delivery.
