    Hi All,

I recently sent a complaint using the MSE template for mis-sold PPI to HFC.

It relates to a loan I took out with them in July 1997 and which ended in July 2001. I have the loan account number but no other details in terms of agreements etc.

They have responded this morning confirm when and at which branch my loan was processed and which company provided the PPI cover. They also confirm when the account was closed. None of this information was disclosed by me in my letter.

However they then go on to say that " In accordance with the Data Protection Act and the Proceeds of Crime Act, HFC bank is required to destroy all copies of documents from your account six years after it's closure. Therefore we are unable to investigate your claim further".

I thought the six year time elapse may be an issue but the fact that they have been able to find details such as when and at which branch the loan was taken out, which compnay provided the PPI cover and the exact date the account was closed suggest to me that they must have more details than they are suggesting!?!

Has anyone got any ideas of a different angle of attack or if banks keep agreements / info beyond six years?

    Many Thanks,

Unfortunately, the rule is they are only legally obliged to retain info for a period of 6yrs after which time they can destroy it.

Have you tried a SAR request? It might be worth it to see what they actually do have and have kept, as they do seem to be using the 6yr rule, it will cost £10 but they should return it if they have nothing, you never know they may send something, in which case you can use this against them also.

Sometimes info is stored on microfiche beyond the 6yrs.

You may also want to write back and ask them when you supplied the account number how were they able to locate this info. To me it means they still have you on record

    Hello lovely, helpful people!

I'm feeling a bit stupid and not sure what if anythign to do next.

We took out a First Plus loan orginally in 2004, moved in 2006 (had to redo the loan etc). Anyway, got sold the ppi as a savings scheme, not relaly realising that it was a lump sum covering 5 years with payments spread over the term.

Did the 1st standard template to FP stating missold as not savings scheme, not properly explained etc etc. Got letter back saying that they had passed it on to the original brokers & insurers etc.

Got a letter from Bespoke Finance stating that at the time they were not regulated by FSA and that we had a booklet for the PPI explaining it and had signed the laon agreement and based on this they will not uphold our complaint.

Is there anything that I can do or is that it now? There's so much info all over the place that I'm not sure whether any of it applies to us or whether we fall into the unlucky band that are unable to do anything.

Sorry for being so long winded! Any advice would be appreciated.

    Thanks,

    Mx
Now why does that not surpise me.

Firstly can you please write a letter to the OFT and FSA about this and make a complaint (your compaint will be added to a list there to see the fitness of them holding a licence) that this company from GIB sold you a loan and PPI and was not (and is still not!!) regulated here in the UK although they do hold a consumer credit licence.

Secondly, have you sent another letter to Bespoke to reiterate your complaint here??

    Hi Marshallka

Am good thank you. Will catch up with your message later. Have been working. Hope you ok.
Yeah fine maxdp, going to get the screening done tomorrow and then 10 days wait... . I want to know today or yesterday though:mad: . At least something is being done at long last. I suppose they have to wait until other things are out before doing these tests.

I have not heard anything about either firstplus or co-op yet. Emailed both cases and not got back to me. I will try again tomorrow.:D

Marshallka, all the best for tomorrow hun.;)

I thought my lloyds case would be a straight forward case to deal with - but obviously not...... , or the adjudicator would have confirmed this by now - I'm sure...... .

Hope you hear about your two, it seems like you've been waiting a very long time.
Hubby not heard anything about fast track yet either, so its very unlikely he will be having this.
