    Hi ,

I think this is not my day, I sent compliants for PPI (via Solicitor) to FOS because all refused to pay out... only to find it could be 12months before I find out wether I win or not...

This all happened with claimimg bank charges mine got put on hold (stay) till test case done.... I then read article today that said banks won second round copy below:
(Good news for banks over bank charge test case

    October 24, 2008

The start of this year also saw the start of a High Court test case into overdraft charged imposed by banks in the UK. Banks had been receiving millions of pounds worth of claims over bank charges going back as far as 2001, but in the summer of 2007 the claims that were still pending in the courts were all put on hold following the decision to take the matter to the High Court.
The first round of the battle was won by the Office of Fair Trading, which had accused the banks of unfair and unlawful practices over the charges. However, it seems that round two has gone to the banks, with the presiding judge deciding that most consumers will not be able to challenge the terms and conditions of most of the banks under common law, with the exception of Intelligent Finance and NatWest, which are still being looked at.
After the recent announcement the Consumer Action Group said: “Some banks will be breathing a sigh of relief as the judge appears to have decided that these charges were not penalties under common law.” The British Banker’s Association added: “The question of penalties was one of the claims made by the OFT which triggered the initial court case. Now we have had this judgement we are keen to move on to the next stage as quickly as possible.”
An official from the OFT said: “This is another staging post in a complex legal process. We are progressing our investigation as quickly as possible and are in continuing discussion with the banks about our provisional views on the issue of fairness.”)

and I also got letter for Motgage company saying I need to catch up with payments or they going to take legal action... I am so not having a good day!!!!

I think there is a huge list of people awaiting fos to sort out their claims, think they are overwhelmed with ppi claims.

I think with the bank charges and the recent news about the banks, I believe its to do with overdrafts not normal bank charges ie bounced cheques etc.

Does anybody know how the FOS allocate complaints is it on time barred or just that they do one batch altogether. It does not make sense to me.

Got letter from FOS today. It says "I am now able to confirm that the next letter we send you will be from the team manager who will be responsible for dealing with your case"

Does that mean the adjudicator do you think?

Posted this up earlier but no-one replied (boo hoo). Not sure if team manager is the same as adjudicator but if it is, then so far it's been 6 months since I sent my complaint in. So doesn't seem to be any rhyme or reason to how long you wait

Not heard from them, their letter says we plan to reply by 2 dec 08 with a full response - 28days if not will write and let me know and explain what action I can take, haa haa I know what action I need to take ff.

I'm still confused as to why I had to complete that ppi questionnaire?

    Hi Anne Jade

Not sure what team manager means mine have gone from nobody straight to adjudicator. Perhaps because they have been so busy they are bringing another tier into the equation to help things to proceed.
