Very quickly. Had a response letter from them within about a week. I'd asked them what recourse was available when a bank dd not comply with a CCA request and they suggested the FOS was the most appropriate route. When I forwarded that letter to the FOS, the FOS position went from being something they weren't interested in to considering it!

I have notced on CAG that a few people who have done similar with the CCA issues and the FOS have been told that the FOS do not think it is in their remit to consider the legality of agreements, so I'm not holding out much hope on that front!
Thats worth knowing then. Perhaps we all ought to complain to the OFT and get them to put their pennys worth in and see from there. Thanks for sharing this bathgatebuyer...;)

I only sent my 1st letter last week but just wanted to confirm that if HFC decline to give me my PPI back and I have to take it to the ombudsman, does this mean Il' probably have to wait upto a year for it to be sorted?

If this has already been answered sorry lol

I think if it goes to the ombudsman you probably will have to wait that long.

Got letter from FOS today. It says "I am now able to confirm that the next letter we send you will be from the team manager who will be responsible for dealing with your case"

Does that mean the adjudicator do you think?

Posted this up earlier but no-one replied (boo hoo). Not sure if team manager is the same as adjudicator but if it is, then so far it's been 6 months since I sent my complaint in. So doesn't seem to be any rhyme or reason to how long you wait
I have not heard of team manager before only with the Firstplus one. That one went before a manager to see if it was something they could look into. I think there is something about firstplus as these are the only ones that I see this with... . I have just looked at my letters and this was with a manager first.. then it went to an adjudicator for one day and then they wrote again and said outside jurisdiction and had to write to the insurer as it was not right to make the complaint against firstplus.

Hope you enjoyed the theatre I've missed loads of posts too.

Not heard from them, their letter says we plan to reply by 2 dec 08 with a full response - 28days if not will write and let me know and explain what action I can take, haa haa I know what action I need to take ff.

I'm still confused as to why I had to complete that ppi questionnaire?
Did you have a PPI questionnaire from FF??

I don't understand this thing with having to go to the insurer as the T & Cs are on a firstplus credit agreement, to me its their rules when rebating:confused:

Yeah can't remember everything on it but do remember them asking:

    When loan took out
    Was it settled and when
    How much rebate given

    other things but can't remember

No, the terms and conditions of the PPI are on the PPI policy and its that that determines the rebate. Its about a term on there and also that it had no cancellation on the policy either of either the 14 days or 30 days... .
