No, the terms and conditions of the PPI are on the PPI policy and its that that determines the rebate. Its about a term on there and also that it had no cancellation on the policy either of either the 14 days or 30 days... .

oh I see, I think I was getting myself confused because as my loan and single prem ppi was added together on one credit agreement I took it that the agreement told you of the rebate, rule of 78 for them both being firstplus T & Cs

To be honest I don't think I've seen any T & Cs on the ppi booklet about rebates:confused:

That's what I got sent by the OFT when I raised this issue with them. After sending this to the FOS, they became interested. However, clearly the OFT believe it fundamental to a Bank being an organisation worthy of holding a consumer credit licence!
Almost debt-free, but certainly even with the Banks!

I have not heard of team manager before only with the Firstplus one. That one went before a manager to see if it was something they could look into. I think there is something about firstplus as these are the only ones that I see this with... . I have just looked at my letters and this was with a manager first.. then it went to an adjudicator for one day and then they wrote again and said outside jurisdiction and had to write to the insurer as it was not right to make the complaint against firstplus.

How long did it take between the manager and the adjudicator? I wrote to FirstPlus a few times setting out my reasons for why they missold and they replied every time, they never said anything about going to the insurer to me and they offered me enhanced rebates. This was for loans in 2005/6, I think yours were previous weren't they Marshallka?

It just says on the letter that MBNA do not accept the outcome of the assessment and therefore the complaint has been forwarded to the ombudsman.

    Good luck
Hope this gets dealt with soon then.

Like our Maxdp said my case had a taken 14 or so months due to the complexity of my complaint, different loan company though, fingers crossed yours will run through easier and quicker that mine did.;)
