Does anybody know how the FOS allocate complaints is it on time barred or just that they do one batch altogether. It does not make sense to me.

    Hi Home James

If it has been upheld by the adjudicator why is it going to the Ombudsman is it because MBNA will not comply.

I know Di had case last year that I think took about 15 months from start to finish.

Yes MBNA appealed the decision so it has gone to the Ombudsman for a final decision hopefully if its completed in 15 months I will be happy as that should be by the end of next month fingers crossed:rotfl:

My claim against MBNA has been with the FOS for over a year (submitted in September 2007) its been upheld by the adjudicator and now awaiting final decision by ombudsman, I sent an email on monday and they send their appologies but tell me there are lots of complaints waiting to be dealt with and they will get round to it eventually.
Its really not fair when this happens.. I hope you get "stress" money too.

I think if the lenders let it go to the ombudsman and its won again then they should fine them too. (a bit like wasting police time!!)

Thank you for that Home James

Here is keeping fingers crossed for you . Why did they appeal. What reasons did they give. If that is not personal and private;)

  • Wow - that's some length of time it's taking to get a decision, isn't it? I received a letter from the FOS about a month ago saying that they had all the info they requred for my complaint against Sainsburys and it was awaiting being passed to an Adjudicator for a decision. I was hoping that meant that things were likely to be resolved by Xmas, although doesn't sound very likely! How long is it likely to take when in the Adjudicator's hands?
Almost debt-free, but certainly even with the Banks!

I have asked that one to the adjudicator and I think they note it if you tell them about it. I have said that if I do not get my complaint through to the FOS then I want the opportunity to take it to the courts and if they take 12 months then I get time barred. Its just not fair.. I have asked for this with the Firstplus unfair rebate complaint but was assured that the complaint lies with the insurer and the insurer is under compulsory jurisidiction. I cannot see how they can think its fair if it does get through to the FOS..
